§ 9-11-1-4 TOBACCO CONTROL.
   (A)   The Fire Marshal's Office of the Albuquerque Fire Department shall be the lead agency coordinating the efforts of other city departments to ensure the following:
      (1)   (a)   Provision of signs shall be the responsibility of persons authorized to sell tobacco products under the provisions of this article.
         (b)   The signs shall be in accordance with the state Tobacco Products Act, Sections 30-49-1 to 30-49-12 NMSA 1978.
         (c)   The signs shall include the following statements written in red lettering:
            (1)   'A PERSON LESS THAN 18 YEARS OF AGE WHO PURCHASES A TOBACCO PRODUCT IS SUBJECT TO A FINE OF UP TO $1000.'
            (2)   'A PERSON WHO SELLS A TOBACCO PRODUCT TO A PERSON LESS THAN 18 YEARS OF AGE IS SUBJECT TO A FINE OF UP TO $1000.'
      (2)   Investigation and enforcement of the provisions of this article.
   (B)   The Environmental Health Department, the Albuquerque Police Department, and Zoning Enforcement shall assist and cooperate with the Fire Marshal's Office in the enforcement of this article.
   (C)   The Mayor, or the Mayor's designated agents, may issue citations for violations of the provisions contained herein in order to enforce this article.
