§ 8-6-27 SUNSCREENING MATERIAL ON WINDOWS.
   (A)   No person shall operate a motor vehicle that is registered or required to be registered in this state on any street or highway if that motor vehicle has a sunscreening material on the windshield or any window that does not comply with the requirements of this section.
   (B)   No person shall apply, install or otherwise affix sunscreening material to a motor vehicle, which material does not comply with the requirements of this section.
   (C)   No person or entity operating a business within the City shall allow the employees, agents, or contractors of the business to apply, install or otherwise affix sunscreening material to a motor vehicle, which material does not comply with the requirements of this section.
   (D)   (1)   Except as otherwise provided in this section, a sunscreening material:
         (a)   When used in conjunction with the windshield shall be nonreflective, shall not be red, yellow, or amber in color and shall be used only along the top of the windshield, not extending downward more than five inches from the top of the windshield; and
         (b)   When used in conjunction with the safety glazing material of the side wings or side windows located at the immediate right and left of the driver (the front doors), the sunscreen material light transmission shall not be less than 35% plus or minus 3% with a luminous reflectance of not more than 33% plus or minus 3%. The sunscreening material on the side windows behind the driver and the rear most window shall have a light transmission of not less than 20% plus or minus three percent, with a luminous reflectance of not more than 33% plus or minus 3%.
      (2)   It shall be unlawful for any person to operate a vehicle on any street or highway with a sunscreening material on the windows that has a light transmission of less than 20%.
   (E)   The provisions of this section do not apply to a motor vehicle registered in this state in the name of a person or the person's legal guardian who has an affidavit signed by a physician or an optometrist licensed to practice in this state that indicates the person has a physical condition that makes it necessary to equip the motor vehicle with sunscreening material which is in violation of this section. The affidavit shall be in the motor vehicle.
   (F)   The light transmission requirement of this section does not apply to windows behind the driver on trucks (over 10,000 lbs.), buses and motor homes.
   (G)   Definitions. As used in this section:
   LIGHT TRANSMISSION. The ratio of the amount of total light which passes through a product or material expressed in percentages to the amount of the total light falling on the product or material.
   LUMINOUS REFLECTANCE. The ratio of the amount of total light expressed in percentages which is reflected outward by the product or material to the amount of total light falling on the product or material.
   MANUFACTURER. Any person engaged in the manufacturing or assembling of sunscreening products or materials designed to be used in conjunction with motor vehicle glazing materials for the purpose of reducing the effects of the sun.
   NONREFLECTIVE. Designed to absorb light rather than to reflect it.
   SUNSCREENING MATERIAL. Any film material, substance, device or product that is designed to be used in conjunction with motor vehicle safety glazing materials for reducing the effects of the sun.
   (H)   Any vehicle operated on any street or highway that has a sunscreening material on the windshield or windows contrary to divisions (B)(1)(a) and (b) shall be exempt provided the material had been installed prior to the effective date of this section. Proof that the material was applied prior to the effective date shall be the responsibility of the vehicle owner and shall be in the following form:
      (1)   Receipt from the installer or dealer with the installation date clearly marked; or
      (2)   Notarized affidavit signed by the owner of the vehicle affirming that the material was applied prior to the effective date of this section.
   (I)   All vehicles not in compliance with the provisions of division (B) as of the effective date of this section shall fully comply upon transfer of ownership.
