(A) No person who is below the legal age to purchase alcoholic beverages as specified in state statutes shall operate a motor vehicle while knowingly having in his possession any alcoholic liquor, whether such liquor is in an opened or unopened container.
(B) Any person under the age of 18 years of age who violates this section shall be charged as a juvenile offender pursuant to the Delinquency Act, Chapter 32A, Article 2 NMSA 1978.
