(A) Permit.
(1) Upon initial application and the tendering of the installation fee the Mayor, or his designated representative, may grant a curb loading zone permit, but only if the following conditions are met: a business or a charitable or a health care organization is making the application; parking is allowed on the same side of the street in the same block; parking in the area is generally difficult to obtain; traffic conditions are congested during the business hours of the day; a curb loading zone would not increase the congestion; and the place of business or charitable or health care organization has a genuine need for a curb loading zone.
(2) Need shall be determined by the nature of the business or organization. If the business is one in which most of the business contacts are brief pick-up and deliveries, then "need" is established. If most of the contacts last for 20 minutes or more in time, "need" must be specifically proven by the business making application to the Mayor or his designated representative. However, it shall be determined that there is no "need" if the business or charitable or health care organization applying for the permit has a loading dock.
(3) Each permit shall expire at the end of each calendar year. Each re-application and the conditions to be met shall be reconsidered annually, An annual maintenance fee shall be tendered with each annual re-application.
(4) Every curb loading zone shall be subject to any regulations on parking to which the parking stalls on the same street are subject.
(5) The Mayor, or his designated representative, may impose conditions and general regulations for the use of the signs indicating the curb loading zones, and he shall require reimbursement to the city for the value thereof in the event of their loss or damage and their return in the event of misuse or upon expiration of the permit.
(B) Fees. The Mayor shall set a fee schedule by rule to cover reasonable administrative expenses based on approximate city costs in order to cover the cost of application processing, loss of parking revenue, curb loading zone installation, and periodic maintenance.
(C) Designation. Upon the basis of a traffic engineering study, the Mayor, or his designated representative, is hereby authorized to determine the location of curb loading zones and shall place and maintain appropriate signs indicating the same and stating the hours during which the provisions of this subsection are applicable.
