§ 7-8-6 DUTIES AND POWERS OF THE DIRECTOR.
   (A)   The Director shall establish a follow-up referee inspection station with the following responsibilities and capabilities:
      (1)   It shall be available without cost to any person requesting a verification test to resolve a question or dispute concerning the results of an emissions test conducted at any other authorized inspection station.
      (2)   It shall be available without cost to any motor vehicle which has failed an authorized emissions inspection and wishes, after tuneup or other relevant repair, to be issued a "pass" certificate of inspection.
      (3)   It shall issue certificates of inspection in the limited situations designated in this division (A).
      (4)   This facility shall have at least one lane equipped with an approved computer-operated exhaust-gas analyzer, staffed and operated during normal business hours.
   (B)   The Director will receive, investigate, and maintain records for complaints regarding authorized inspection stations or inspectors, and will forward such complaints and the written results of the Director's investigation to the Board for its final determination.
   (C)   The Director shall refer complaints in regard to the work of certified emissions inspectors and inspection stations to the Consumer Affairs Department of the Bernalillo County District Attorney's Office or the Consumer Protection and Economic Crimes Division of the New Mexico Attorney General's office.
   (D)   Certificates of Inspection shall be issued to owners of tested vehicles which comply with Board regulations. Pass and Time Limit Extension Certificates of Inspections shall be serially numbered with distinctive style.
   (E)   The Director shall enter into a binding agreement with the New Mexico Motor Vehicle Division (MVD) whereby motor vehicles covered by this article and registered with the MVD to an owner who resides within Bernalillo County will only be eligible for re-registration if the owner presents a valid Certificate of Inspection issued by the Director with the registration application.
   (F)   The Director shall approve all exhaust gas analyzers which meet Air Quality Control Board criteria to be utilized for the testing of exhaust emissions of a motor vehicle.
