The Mayor shall place a wrecker on a rotation list in the year for which the wrecker has applied when the Mayor finds:
(A) That the applicant is the owner of a Warrant to provide wrecker service;
(B) That insurance policies as required by this article have been procured, and the appropriate certificates provided to the City of Albuquerque;
(C) That the applicant and all employees have a valid license from the State of New Mexico, Motor Vehicle Division, and are fit and proper persons to conduct or work for the proposed business, none of whom have ever been convicted of a felony;
(D) That all the requirements of this article and regulations promulgated pursuant to it and all other laws of the state and this code of ordinances and any other applicable ordinances of the city have been met; and
(E) That applicants whose business location and/or storage area is outside the city boundary have agreed in writing to comply with the provisions of this article and all other applicable city and state laws, rules, and regulations, and have made arrangements that are satisfactory to the city to allow access and entry by city personnel to the business and/or storage area. Further, that they have agreed not to charge City of Albuquerque non-consensual tow vehicles any mileage in excess of that to the city limits.
