(A) The SRC shall review the SAD Engineer's Report and decide whether or not to recommend creation of the SAD to the Mayor. The SRC shall direct the SAD Engineer to prepare a transmittal letter to the Mayor setting forth its recommendation and supporting rationale. The letter shall be signed by the SRC members and shall be attached to the SAD Engineer's Report.
(B) The SAD Engineer's Report shall not be considered by the SRC unless the funding for city contributions already has been appropriated. SAD capital appropriations shall be project specific and shall be identified in the appropriating resolution with regard to the SAD. Special assessment district funding will become a part of the normal Capital Improvement Program budgetary and planning process. Costs of the SAD improvements will be formally appropriated as part of the Capital Improvement Program process.
(C) The SRC shall assign to every SAD which it supports, prior to transmittal of the SAD Engineer's Report to the Mayor, a priority for scheduling its progress relative to all approved SADs as well as those SADs for which a "Request for Construction of Public Improvements by the Special Assessment District Method" have been received. The SRC will report to the Mayor its proposed revisions to SAD development schedules together with the SAD Engineer's Report. The SRC report will include an analysis of the effect of any revised prioritization of Active Special Assessment Districts and the consequences of such revised prioritization on the schedule for completion of Active Special Assessment Districts.
(D) The Mayor shall review the SRC recommendation and the SAD Engineer's Report. At his discretion, the Mayor may call for additional information from the SRC or the SAD Engineer. If the Mayor decides that creation of the SAD should be recommended, the Mayor will direct the SAD Engineer to prepare a transmittal memo to the City Council transmitting the SAD Engineer's Report for review and approval. The memo will be prepared for the Mayor's signature. If the Mayor decides that the creation of the SAD will not be recommended, the SAD Engineer shall prepare a memorandum that will be attached to the SAD Engineer's Report stating the reasons for the Mayor's decision not to recommend creation of the SAD. The SAD Engineer shall then notify, in writing, all persons who requested the improvements in the SAD, of the Mayor's decision.
(E) Subsequent to the Mayor's approval of recommending the creation of the SAD, the SAD Engineer's Report, SRC Report and transmittal letter as signed by the SRC shall be sent to the City Council for a decision as to the propriety of initiating the proposed SAD as recommended by the Mayor. The SAD Engineer will make a presentation to the City Council describing the need for the SAD and the specific improvements therein. With City Council approval of the SAD Engineer's Report, the SAD Engineer shall proceed to the selection of a Consulting Engineer for the SAD. The selection of the Consulting Engineer shall be made pursuant to and in accordance with the Selection Advisory Committee Ordinance.
(F) Expenditure of City Funds. The expenditure of city funds for an SAD prior to adoption of the resolution modifying, confirming and approving the Assessment Roll for such SAD (commonly known as Resolution No. 5) will be limited to preliminary expenditures such as architectural, engineering, surveying, soil testing, appraisal, real property record searches, and similar preliminary expenditures and, until such time, no city funds will be spent on costs of materials for the construction of SAD improvements. The city may acquire public right-of-way and make other expenditures related to a particular SAD which may be reimbursed from proceeds of bonds for the SAD only upon satisfaction of the requirements of the Internal Revenue Code of 1986, as amended, for declaring the intent of the city to reimburse such expenditures from bond proceeds.
