(A) A construction permit may be granted for sidewalk, drive pad, curb ramp, and/or curb and gutter construction to a contractor properly licensed according to the laws of the state provided the person has on file with the city a maintenance bond in the amount of at least $5,000 which bond guarantees the completed project against defects or improper construction for one year from the date of completion. These requirements are supplemental to the bond requirements set forth in §§ 6-5-2-1 et seq., Street Excavation and Barricading.
(B) A construction permit may be granted for curb ramps, sidewalk and/or drive pad but not curb and gutter construction to any property owner wishing to lay, construct or build his or her own sidewalk or drive pad or curb ramp on any public right-of-way abutting his or her premises, provided said property owner has on file with the city a maintenance bond in the amount of at least $1,000 which bond guarantees the completed project against defects or improper construction for one year from the date of construction and evidence of public liability insurance in the amount of at least $500,000. These requirements are in lieu of the bond requirements set forth in §§ 6-5-2-1 et seq. Street Excavation and Barricading.
(C) When specific city construction projects under contract require a one year performance bond, the maintenance bond prescribed herein will not be required.
