§ 6-5-5-4 DEFINITIONS.
   For the purpose of §§ 6-5-5-1 et seq., the following definitions shall apply unless the context clearly indicates or requires a different meaning.
   CONSTRUCTION PERMIT. The authorization issued to a contractor or property owner permitting the construction of sidewalks, drive pads, curb ramps or curbs and gutters in compliance with the provisions of §§ 6-5-5-1 et seq.
   CROSSWALK.
      (1)   That part of the streets at an intersection which is a prolongation or continuation of the lateral lines of the sidewalk on opposite sides of the street measured from the curbs, or in the absence of curbs, from the edge of the transversible street and/or;
      (2)   Any portion of a street, at an intersection or elsewhere, distinctly indicated as a pedestrian crossing by line or other surface markings.
   CURB. The vertical or steeply sloping member which forms the stand-up part of the curb and gutter combination or which may be constructed without a gutter section as a header curb.
   CURB CUT. Any break in a curb which facilitates access to or from a street or alley.
   CURB RAMP. A paved pedestrian way within the public right-of-way which provides wheel chair access from a street to a sidewalk.
   DRB. The Development Review Board, an administrative board consisting of six representatives of city departments and other agencies, including the Planning Director as Chairperson, Zoning Enforcement Officer, City Engineer (who may also function as the AMAFCA designee), Traffic Engineer, Parks & Recreation Director, and Albuquerque-Bernalillo County Water Utility Authority Water Resources Engineer.
   DRIVE PAD. A paved vehicular way which may be either part, all, or not at all within the public right-of-way and which provides vehicular access from a public right-of-way to property abutting the right-of-way.
   DRIVEWAY. A vehicular way which may be either part, all, or not at all within the public right-of-way and which provides vehicular access from a public right-of-way to property abutting the right-of-way.
   GUTTER. A horizontal or slightly sloping member which may form the base of the curb and gutter combination and which may be constructed as an integral part of the curb-gutter combination or may be constructed as a separate member without curb section.
   LANDSCAPE/BUFFER AREA. The part of the public right-of-way which is not occupied or planned to be occupied by street, curb, gutter, or sidewalk and which may be used for street furniture, street trees and vegetation, and utilities. Typically located between the back of curb and adjacent property line.
   MAYOR. The Mayor or his or her designated representative.
   MOUNTABLE CURB. A curb and gutter combination which is designed to be transversible by a vehicle and which provides wheel chair access from a public right-of-way to property abutting the right-of-way.
   PEDESTRIAN. Any person afoot or in a wheel chair or other similar device.
   PERSON. An individual, co-partnership, joint venture, association, corporation, social club, fraternal organization, estate, trust, business trust, receiver syndicate, or other group or combination acting as a unit.
   PUBLIC RIGHT-OF-WAY. The total area of land deeded, reserved by plat or otherwise acquired by the city primarily for the use of the public for purposes of vehicular and/or pedestrian traffic.
   SIDEWALK. That portion of the public right-of-way which is primarily devoted to pedestrian use.
   STREET. That portion of the public right-of-way which is primarily devoted to vehicular use.
   STREET FURNITURE. Any above grade appurtenance placed within the public right-of-way for the general convenience and use of the public such as, but not limited to, benches, litter baskets, utility poles, street lights, traffic control devices, mail boxes, telephones, fire hydrants and the like.
   VARIANCE. A variation in the location, materials or other requirements of §§ 6-5-5-1 et seq.
   VEHICLE. Any device in, upon, or by which any person or property is or may be transported or drawn upon a roadway or street, but not including wheelchairs.
