Any person, firm, association or corporation who shall erect, locate, or install, or who shall cause to be erected, located or installed any building, structure, excavation, well or sub-surface structure as herein defined contrary to the provisions of §§ 6-5-3-1 et seq., shall be guilty of a misdemeanor and upon conviction thereof, shall be punishable by a fine of not less than $50 and not more than $200. Each such person, firm, association or corporation shall be deemed guilty of a separate offense for every day during any portion of which any violation of any provision of §§ 6-5-3-1 et seq. is permitted or continued by such person, firm, association or corporation, and shall be punishable therefor as provided herein; provided that any building, structure, well, excavation or subsurface structure, as defined herein, existing on the effective date of §§ 6-5-3-1 et seq. shall not be deemed to be a violation of said sections.
