§ 4-9-2 DEFINITIONS.
   For the purpose of this article, the following definitions shall apply unless the context clearly indicates or requires a different meaning.
   ARENA. An arena, including land, buildings and improvements, located within or near the downtown area of the city constructed after July 1, 2004, and with a seating capacity of at least 8,200 fixed and an additional 1,800 flexible seats.
   ARENA RECEIPTS. The total amount of money or the value of other consideration paid to a vendor by a user for property or services related to the Arena or related to activities occurring at the Arena, whether occurring at the Arena or not, including but not limited to, tickets, parking, souvenirs, concessions, programs, advertising, merchandise, corporate suites or boxes, and broadcast revenues, for use by the purchaser of the property or service. ARENA RECEIPTS shall include interest and penalty related thereto. ARENA RECEIPTS shall not include:
      (1)   the total amount of money or the value of other consideration paid for constructing, renovating, equipping, operating, maintaining or improving the Arena or for administering the Arena Surcharge; or
      (2)   amounts paid by users and collected by vendors as the Arena Surcharge.
   CITY. The City of Albuquerque, New Mexico.
   NON-PROFIT. The non-profit entity or entities organized under the law of New Mexico, proposing to construct, own and operate the Arena so as to lessen the burdens on the city, which entity or entities may obtain a loan from the New Mexico Finance Authority or elsewhere to finance the construction and operation of the Arena and ownership of teams which will use the Arena.
   TREASURER. The City Treasurer or the Treasurer's duly authorized delegate.
   USE. Includes use or storage or consumption of property or a service. Excludes subsequent sale or resale by the purchaser of the property or service.
   VENDOR. Every person, corporation, partnership or other entity, including a division or department of the city, providing products or services sold at or related to an arena within the city, whether occurring at the arena or not, including but not limited to, tickets, parking, souvenirs, concessions, programs, advertising, merchandise, corporate suites or boxes, and broadcast revenues.
