There shall be and is hereby established in the City of Yuma a municipal court to be known and designated “The Municipal Court of the City of Yuma, Yuma County, State of Arizona,” which court shall always be open except on non-judicial days, and on such non-judicial days it may transact such business within its jurisdiction as is authorized by general law to be transacted by courts of Justice of the Peace relative to business within their jurisdiction. The term “Municipal Court of the City of Yuma, Yuma County, State of Arizona” as used in this section includes “The City Court of the City of Yuma, Yuma County, State of Arizona” and all other courts established by law in incorporated cities and towns. The term “Municipal Judge” as used in this Article includes “City Magistrate.” (Gen. Elec. 12/6/77)
Said court shall, within the territorial limits of said city, have and exercise jurisdiction as follows:
(a) It shall have and exercise exclusive original jurisdiction of all proceedings of a criminal nature for the violation of any ordinance of said city; and of every action of a civil nature for the enforcement of a penalty or the recovery of a penalty or forfeiture imposed by any ordinance of said city for violation thereof, or for neglect to perform any duty by any ordinance imposed; and of every action for the collection of any license-tax or penalty due from any person to said city and required to be paid, or which is due and collectible under the ordinances of said city.
(b) Appeals may be taken to the Superior Court of Yuma County, State of Arizona, on the judgments and orders of said municipal court in all cases in which appeals now or hereafter may be taken to said Superior Court from the Justices' Courts. (Gen. Elec. 12/6/77)
(a) There shall be a Municipal Judge who shall be elected from the City at large in accordance with state law. Commencing with the elections held in 1973, and at the biennial elections held every four (4) years, thereafter, a Municipal Judge shall be elected who shall serve a term of four (4) years. On and after January 1, 1995, at such time as City Council shall deem necessary, other Municipal Judges shall be elected, at staggered elections, for a term of four years. The Municipal Judges shall receive at stated times, a compensation to be fixed by ordinance by the City Council, which compensation shall not be increased or diminished after their election or during their term of office. (b) The chief officer of the Municipal Court shall be the Presiding Judge who shall be elected commencing with the elections held in 2009. (Sp. Elec. 12/7/93; Sp. Elec. 11/6/07)
(c) The qualifications for election to the position of presiding judge shall be the same as for pro tem judges set forth in Article VI, Section 31 of the Arizona Constitution. (Sp. Elec. 11/6/07)
(d) The qualifications of municipal judges other than the presiding judge shall be: at least 30 years of age, of good moral character with no felony convictions, and, in addition to the requirements of the Yuma City Charter, Article VI, Section 13, be a resident of the city for at least five (5) years preceding the day of election or appointment.
