Article VIII
City Administrator
Sec. 1. Appointments; qualifications and compensation.
   The City Council shall appoint a city administrator for an indefinite term and fix his compensation. The city administrator shall be appointed solely on the basis of his executive and administrative qualifications. He need not be a resident of the City of Yuma at the time of his appointment but shall reside in the city while in office. (Sp. Elec. 4/7/70; Gen. Elec. 11/6/01)
Sec. 2. Removal of city administrator.
   The City Administrator or Acting City Administrator may be removed with or without cause at any regular or special meeting by vote of four or more members of the city council. In the event of his removal, the city council may at its discretion pay the city administrator any sum not exceeding two months salary as severance pay. (Sp. Elec. 4/7/70; Gen. Elec. 11/6/01)
   A dismissed city administrator shall be entitled, upon request, to a public hearing before the City Council. However, the action of the city council shall be final and conclusive, and not subject to review by any court or agency. It is the intention of this charter to vest all authority and fix all responsibility for such suspension and removal in the city council. (Sp. Elec. 4/7/70; Gen. Elec. 11/6/01)
Sec. 3. Acting city administrator.
   The city administrator shall designate as acting city administrator, subject to the approval of the city council, a qualified city officer to exercise the powers and perform the duties of city administrator during his absence or disability. The designation shall be by letter filed with the city clerk. During such absence or disability the city council may revoke such designation at any time and shall appoint another officer of the city to serve as acting city administrator until the city administrator shall return or his disability shall cease. Sec. 4. Responsibilities and duties of the city administrator.
   The City Administrator shall be the chief administrative officer of the city. He shall be directly responsible to the city council for the administration of all city affairs placed in his charge by or under this charter, or by ordinance.    (a)   He shall appoint and, when he deems it necessary for the good of the city, suspend or remove any city employee or appointive administrative officer provided for by or under this charter, except as otherwise provided by law, this charter or personnel rules adopted pursuant to this charter. He may authorize any administrative officer who is subject to his direction and supervision to exercise these powers with respect to subordinates in that officer's department, office or agency. (Sp.    (b)   He shall direct and supervise the administration of all departments, offices and agencies of the city, except as otherwise provided by this charter or by law. (Sp. Elec. 4/7/70)
   (c)   He shall attend all city council meetings and shall have the right to take part in discussion but may not vote. (Sp. Elec. 4/7/70; Gen. Elec. 11/6/01)
   (d)   He shall see that all laws, provisions of this charter and acts of the city council, subject to enforcement by him or by officers subject to his direction and supervision, are faithfully executed. (Sp. Elec. 4/7/70; Gen. Elec. 11/6/01)
   (e)   He shall prepare and submit the annual budget and capital program to the city council. (Sp. Elec. 4/7/70; Gen. Elec. 11/6/01)
   (f)   He shall submit to the city council and make available to the public a complete report on the finances and administrative activities of the city as of the end of each fiscal year. (Sp. Elec. 4/7/70; Gen. Elec. 11/6/01)
   (g)   He shall make such other reports as the city council may require concerning the operation of the city departments, offices and agencies subject to his direction and supervision. (Sp. Elec. 4/7/70; Gen. Elec. 11/6/01)
   (h)   He shall keep the city council fully advised as to the financial condition and future needs of the city and make such recommendations to the city council concerning the affairs of the city as he deems desirable. (Sp. Elec. 4/7/70)
   (i)   He or the Acting City Administrator shall execute, attested by the City Clerk all contracts for amounts exceeding $25,000 and such other documents as may be authorized by the City Council, and not prohibited by law. The Purchasing Agent may authorize contracts of $25,000 or less in accord with this Charter and the purchasing ordinance of the City on the terms set forth in such ordinance. (Sp. Elec. 4/7/70; Gen.    (j)   He shall draft for the consideration of the city council such ordinances and resolutions as may be necessary for implementing and supplementing the provisions of this charter as to organization and procedures, as well as any other ordinances or resolutions necessary for the conduct of the affairs of the city.    (k)   He shall perform such other duties as are specified in this charter or as may be required by the city council or by ordinance. (Sp. Elec. 4/7/70; Gen. Elec. 11/6/01)
