3-13-1: DEFINITIONS:
For the purposes of this chapter, the following words and phrases shall have the meanings respectively ascribed to them:
LICENSED PREMISES: The place or location described in a massage establishment license where a massage establishment is authorized to operate.
LICENSEE: The operator of a licensed massage establishment.
MASSAGE: Any method of pressure on, friction against, or stroking, kneading, rubbing, tapping, pounding, vibrating, or stimulating of the external soft parts of the body with the hands or with aid of any mechanical or electrical apparatus or appliances with or without such supplementary aids as rubbing alcohol, liniments, antiseptic oils, powder, creams, lotions, soaps, ointments, or other similar preparations commonly used in this practice.
MASSAGE ESTABLISHMENT: Any person, having a source of income or compensation derived from the practice of massage and which has a fixed place of business where any person engages in or carries out any of such activities.
MASSAGE ESTABLISHMENT EMPLOYEE: Any person who works in or at or renders any services directly related to the operation of a massage establishment; provided, however, that this definition shall not include persons delivering goods, materials, food and beverages, or performing maintenance or repairs to the licensed premises.
MASSAGE ESTABLISHMENT LICENSE: A massage establishment license as provided for in this chapter.
MASSAGE PATRON: Any person, other than a massage establishment employee, present in or at any massage establishment at any time when such massage establishment is open for business; provided, however, that this definition shall not include persons delivering goods, materials, food and beverages, or performing maintenance or repairs, to the licensed premises.
MASSAGE SERVICES: The performance of massage.
MASSAGE THERAPIST: Any person who, for any consideration whatsoever, engages in the practice of "massage" as defined herein.
SEXUAL OR GENITAL AREA: The genitals, pubic area, anus, or perineum of any person, including the vulva or breasts of a female. (Ord. 2011-43, 9-8-2011)
3-13-2: LICENSE REQUIRED:
No person shall conduct, operate or maintain or permit to be conducted, operated or maintained, or participate in the conduct, operation or maintenance of a massage establishment within the village unless the village has issued a license for such massage establishment as provided for in this chapter which is in full force and effect, and such valid and current license is displayed in a conspicuous place within the massage establishment at all times.
