§ 32.045 MEETINGS; QUORUM.
   (A)   Regular meetings.
      (1)   Regular meetings of the Planning Commission shall be held at least quarterly on dates to be determined as needed.
      (2)   Regular meetings will start at 4:30 p.m.
      (3)   When a meeting date falls on a legal holiday, the meeting shall be held on the day following unless otherwise designated by the Planning Commission.
   (B)   Special meetings.
      (1)   Pursuant to W. Va. Code 8A-2-7(b), the Planning Commission may hold special meetings. Notice of the special meeting must:
         (a)   Be in writing;
         (b)   Include the date, time, and place of the meeting; and
         (c)   And be sent to all members at least two days before the special meeting.
      (2)   Written notice of a special meeting is not required if the date, time, and place of the special meeting were set at a regular meeting.
      (3)   Notice for special meetings shall, if applicable, adhere to relevant notice requirements of the West Virginia Code and West Virginia Ethics Commission.
   (C)   Quorum. A quorum of members must be present in order to conduct a meeting. “Present” includes physically present or present via telephone call or present via internet meeting programs (such as Zoom and the like). Any attendance issues shall be resolved by the President of the Planning Commission.
   (D)   Majority votes. When a quorum exists, a majority vote of the quorum shall be required for motions to be passed/adopted.

§ 32.046 PLANNING COMMISSION MAY ACCEPT GIFTS, FUNDS, AND DONATIONS.
   Pursuant to W. Va. Code 8A-2-11, the Planning Commission is authorized to accept gifts, funds, and donations. Said gifts, funds, and/or donations shall be deposited with the appropriate governing body into a special nonreverting Planning Commission fund for expenditures by the Planning Commission for the purpose designated by the donor.

FINE ARTS COUNCIL
§ 32.060 COUNCIL ESTABLISHED.
   (A)   There is hereby established a Weston Fine Arts Council, hereinafter referred to as the “Arts Council”. The Arts Council shall serve as an advisory body to the Common Council and shall be composed of seven members, at least three of whom are residents of the city, with the remaining four members being residents of the county, all appointed by the Mayor, subject to confirmation by a majority of the Common Council. The members are to be appointed for staggered three-year terms. The members so appointed shall serve without compensation.
   (B)   In the event that vacancies may occur in membership of the Arts Council due to death, resignation, or any other cause, the remaining members of the Arts Council shall be enabled to act even if the vacancy causes there to be fewer than two members who are residents of the city. Whenever any vacancy on the Arts Council occurs, the remaining members of the Arts Council shall promptly notify the Mayor and/or the Common Council members that a position is vacant and it needs to be filled for the unexpired term.

§ 32.061 POWERS AND DUTIES.
   The Arts Council shall have the following powers and duties:
   (A)   The ability to promulgate and establish its own rules of procedure;
   (B)   Encourage the cooperation and coordination of projects in the field of arts and other creative events that will enhance the cultural level and activities of the arts in the community;
   (C)   Encourage individual and group activity in the area of creative writing, music, drama, dance, plastic and visual art and related activity, as well as any special historical or other special event as directed by the Common Council;
   (D)   Cooperate with colleges and school districts in the area as well as other groups in the use of facilities and programs, which may be available for future use to foster a broad arts program in the community; and
   (E)   Accept or reject gifts made or offered to the Arts Council for use in connection with the arts program. Gifts of money, or other monetary donations, shall be [reserved].
