§ 34.021 NOT MEMBERS OF POLICE DEPARTMENT.
   Such auxiliary police officers shall not be members of the regular Police Department of the city. Auxiliary police officers shall be residents of the city. Identification symbols worn by such auxiliary police officers shall be different and distinct from those used by the regular Police Department and shall be selected and chosen by the Chief of Police of the city. Auxiliary police officers shall, at all times, during the performance of their duties, be subject to the direction and control of the Chief of Police of the city.

§ 34.022 POWERS AND DUTIES.
   Auxiliary police officers shall have the following powers and duties when properly assigned and on duty:
   (A)   To aid or direct traffic in this municipality;
   (B)   To aid in control of natural or human-made disasters;
   (C)   To aid in case of civil disorder;
   (D)   To perform normal and regular police duties when assigned by the Chief of Police on occasions when it is impracticable for members of the regular Police Department to perform normal and regular police duties;
   (E)   To arrest or cause to be arrested, with or without process, all persons who break the peace, or are found violating any municipal ordinance or any criminal law of the state;
   (F)   To commit arrested persons for examination;
   (G)   If necessary, to detain arrested persons in custody overnight or Sunday in any safe place, or until they can be brought before the proper magistrate;
   (H)   To exercise all other powers as conservators of the peace that the corporate authorities may prescribe; and
   (I)   To serve and execute all warrants for the violation of municipal ordinances, or the state criminal law, within the limits of the city, and for this purpose, to have all the common law and statutory power of sheriffs.

§ 34.023 NO FIREARMS.
   Auxiliary police officers shall not carry firearms, except those that have completed the 40-hour Firearms Training Course, and are in uniform.

§ 34.024 TRAINING COURSE.
   Auxiliary police officers, prior to entering upon any of their duties, shall receive a course of training in the use of weapons and other police procedures by the Chief of Police or his or her designated representative. Such course of training shall not be less than 20 hours in duration. Upon completion of the course of training, the Chief of Police shall file a certificate attesting to the auxiliary police officer’s completion of said course, with the City Clerk.

§ 34.025 COMPENSATION.
   Auxiliary police officers shall receive no compensation for services performed.

POLICE DEPARTMENT
§ 34.040 DEPARTMENT ESTABLISHED.
   There is hereby established a department of the municipal government of the city, which shall be known as the Police Department. It shall embrace the City Council Standing Committee on Public Safety, one Chief of Police and such other regular patrolmen as the City Council may hereafter from time to time provide for, and also such special police officers as the Mayor, in accordance with the provisions of this chapter may appoint and commission.

§ 34.041 PUBLIC SAFETY COMMITTEE.
   (A)   The City Council Standing Committee on Public Safety shall exercise a general supervision over the affairs of the Police Department.
   (B)   It shall ascertain the condition and needs thereof; shall, from time to time, report the same to the Mayor and City Council so that a full understanding thereof shall be had; and, generally shall do all acts necessary to promote the efficiency of the Department.

§ 34.042 HEAD OF DEPARTMENT.
   The Chief of Police of the city shall be the head of the Police Department, subject to the orders of the Mayor, City Council and Committee on Public Safety.

§ 34.043 APPOINTMENT.
   The Chief of Police shall be appointed by the Mayor, by and with the advice and consent of the City Council, to serve for one year, or until his or her successor is appointed and qualified.

§ 34.044 SALARY.
   He or she shall receive such compensation as may be provided by the ordinances of the city or by resolution of the Council.

§ 34.045 DUTIES.
   (A)   The Chief of Police shall devote his or her entire time to the performance of the duties of his or her office, and is hereby charged with the preservation of the peace, order and safety of the city, and with the duty of protecting the rights of persons and property, and of enforcing all laws and also all orders of the City Council.
   (B)   He or she shall take notice of all nuisances, obstructions and defects, on the highways, or other public places, and shall cause the same to be abated or removed, or immediate notice thereof given to the proper officer, whose duty it may be to take action in relation thereto.
   (C)   He or she shall attend, either in person or by deputy, all meetings of the City Council, execute all its orders, and close the Council chamber upon the adjournment of that body. He or she shall also execute all warrants or other legal process required to be executed by him or her under any ordinance of the city.
