§ 90.031 LOCATION OF TREES OR SHRUBBERY PLANTED ALONG SIDEWALKS.
   (A)   All trees or shrubbery planted along or upon the sidewalks of any public street in the city shall be set out in a straight line running parallel to the curb and at a distance of three feet from the outside line of the curb or sidewalk space.
   (B)   Any person who shall plant or set out trees or shrubbery or any owner who shall plant or set out any trees or shrubbery upon sidewalk space abutting his or her property in violation of this section shall be deemed guilty of a misdemeanor.

§ 90.045 PERMIT REQUIRED FOR STREET EXCAVATIONS.
   It shall be unlawful for any person to make any excavation or opening in any street, alley or public highway of the city without first having obtained a permit to do so.

§ 90.046 APPLICATION FOR STREET EXCAVATION PERMIT.
   The application for a permit to make any excavation or opening in any of the streets, alleys or public highways of the city shall be made to the Building Official, who shall grant the permit with the Director of Public Works’ and the City Engineer’s approval, and shall state clearly the name of the street or highway in which it is proposed to make an opening, the exact location in the highway wherein it is proposed to make the opening, the purpose of making the opening and the name of the person who proposes to make the excavation or opening.

§ 90.047 BOND REQUIRED FOR STREET EXCAVATIONS.
   When permits are requested to disturb, dig up or in any way obstruct any street or public place in the city, the Building Official may require from the applicant, before granting a permit, a cash bond, conditioned to secure the city against all loss, damage or injury of any kind which may result to the city by reason of the disturbance, digging up or obstruction of the street. The amount of the bond shall be as determined by the Director of Public Works and the City Engineer.

§ 90.048 ISSUANCE OF STREET EXCAVATION PERMIT; OBLIGATION TO RESTORE SURFACE.
   It shall be the duty of the Building Official, with the Director of Public Works’ and the City Engineer’s approval, when any person shall make application for a permit under the provisions of this subchapter, to grant the permit, specifying therein where the digging is to be done, when it is to be done and the manner of replacing the dirt and surface, and at the same time to take from the person a written obligation for replacing the dirt and surface and restoring the street to as good condition as before the digging was done.

§ 90.049 MANNER OF OPENING STREET; PLACEMENT OF MATERIALS REMOVED.
   In opening a street or other public way, all material for paving or ballasting must be removed with the least possible injury or loss of the material and, together with the excavated materials from the trenches, must be placed where it will cause the least possible inconvenience to the public.

§ 90.050 USE OF SHEETING AND BRACES IN TRENCHES.
   Whenever the sides of trenches dug in the street will not stand perpendicularly, sheeting and braces must be used to prevent unnecessary caving.

§ 90.051 SUPERVISION OF STREET EXCAVATION WORK.
   All the work of excavating or making any character of opening in any of the streets, alleys or highways of the city shall at all times be under the supervision of the Building Official. The person doing the work shall do the work in the manner directed by the Building Official to the end that the streets and highways of the city shall not be unduly disturbed and traffic thereon obstructed.
