911.001 DEFINITIONS.
   Whenever used herein, the words listed below shall be defined as follows:
   (a)    "Plat" means a map of a tract or parcel of land.
   (b)    "Subdivision" means:
      (1)    The division of any parcel of land shown as a unit or as contiguous units on the last preceding tax roll, into two or more parcels, sites or lots, any one of which is less than five (5) acres for the purpose, whether immediate or future, of transfer of ownership; provided, however, that the division or partition of land into parcels of more than five acres not involving any new streets or easements of access, and the sale or exchange of parcels between adjoining lot owners, where such sale or exchange does not create additional building sites, shall be exempted; or
      (2)    The improvement of one or more parcels of land for residential, commercial or industrial structures or groups of structures involving the division or allocation of land for the opening, widening or extension of any street or streets, except private streets serving industrial structures; the division or allocation of land as open spaces for common use by owners, occupants or lease holders or as easements for the extension and maintenance of public sewer, water, storm drainage or other public facilities.

      (3)    A proposed division of a parcel of land along an existing public street, not involving the opening, widening or extension of any street or road, and involving no more than five (5) lots after the original tract has been completely subdivided.

911.002 PROCEDURE AND FILING OF A LOT SPLIT AND/OR CONSOLIDATION; FEE.
   (a)   Where a proposed division of a parcel of land along an existing public street, not involving the opening, widening or extension of any street or road and involving no more than five lots after the original tract has been completely subdivided such proposed division shall be submitted to Council for approval. The owner or person requesting such approval shall pay a five hundred dollar ($500.00) fee that includes the Engineering fee for review of the lot split and/or consolidation and the cost to record the lot split and/or consolidation with the Cuyahoga County Recorder’s office. The applicant shall submit a sketch of the lands to be divided and such sketch shall indicate thereon the means or method of drainage of storm and sanitary waters. Council shall determine within forty-five days after submission if such proposed consolidation and/or division is not contrary to applicable platting, subdividing or zoning regulations, and whether the method of drainage indicated is approved by the City Engineer. If so determined, Council shall approve such proposed consolidation and/or division and shall direct the Clerk to execute the document.
   (b)   The Building Department is responsible for the collection of the appropriate fees associated with the submission. (Ord. 76-2018. Passed 8-6-18.)
911.01 REGULATIONS; COMPLIANCE.
   (a)    The following rules and regulations relative to the platting of land and the dedication of new streets are hereby adopted and promulgated.
   (b)    No lands within the Municipality shall be platted for subdivision and sale, and no streets offered for dedication shall be accepted, except in conformity to the provisions of this title.

911.02 FILING OF SKETCH.
   An owner of land shall file with the Planning Commission a pencil tracing and five (5) prints of the proposed subdivision, drawn to scale, covering the subdivision layout of the entire area of the owner's lands. This preliminary sketch shall indicate the following:
   (a)    The owner's name and general description of the location of his land shall appear in the title.
   (b)    The names of all owners of abutting property and recorded subdivisions showing dedicated street locations when same terminate at proposed subdivision line.
   (c)    Approximate distances to near-by main or arterial roads.
   (d)    Approximate locations and the proposed width of new streets.
   (e)    Approximate location and dimensions of sublots including sublot numbers.
   (f)    The scale of the drawing and directional point.
   (g)    Topography of land embraced within the proposed subdivision (County Sanitary Department topography maps may be used for this purpose).
   (h)    Directional flow of existing and proposed sewers and connections to any existing or proposed sewers outside of the subdivision. If the septic tank method of sewage treatment is proposed to be used, the owner of the subdivision or his agent shall also present evidence that such method will adequately serve the subdivision and will not cause a health hazard or nuisance to any other property.
   (i)    All easement lines where known, with dimensions and bearings on those covering sewer and/or water installations.
   (j)    Minimum building setback lines along all streets and rear and side yard lot lines.
   (k)    Location of existing sewer outlets.
   (l)    Two prints of the sketch shall be retained by the Planning Commission and the signed tracing with one print shall be returned to the owner. One print of the sketch shall be delivered to the Clerk of Council and one print to the Building Department. If the sketch is approved by the Planning Commission, it shall be signed by the Chairman thereof and the City Engineer.
   (m)    Show location of sidewalks within proposed subdivisions, when applicable.
   (n)    Show the kind of trees to be planted, together with approval of the City Arborist that they comply with the Master Street Tree Plan as adopted in Chapter 707.
   Within sixty days after the date of submission, or resubmission if a resubmission is directed by the Planning Commission, of the preliminary sketch to the Planning Commission, the Planning Commission shall recommend to Council either approval or reasons for disapproval of such sketch, and within one hundred twenty days from the date of the submission, or resubmission if resubmission is directed by the Planning Commission, of the sketch to the Planning Commission, Council shall officially approve or disapprove such preliminary sketch. The Clerk of Council shall notify the Planning Commission within ten days of Council's approval or disapproval of the preliminary sketch and the reasons for disapproval, or under what changed conditions, if any, approval would be given by Council.
   Such approval, if given by Council, shall only be applicable to street and lot locations in general.
   The ordinance which accepts the plat for record purposes must indicate the number of lots, sublots or parcels.

911.021 TOPOGRAPHICAL MAP AND MASTER DRAINAGE PLAN.
   In addition to the information and data required in Section 911.02, the owner of land shall file with the Planning Commission contemporaneously with the filing of the sketch, a topographical map covering the area of the proposed subdivision together with a master drainage plan of such lands for review and approval by the Planning Commission upon the advice and recommendation of the City Engineer. Such topographical map and master drainage plan must be approved prior to the submission by such owner of land of the Record Map as required by Section 911.03.

911.03 RECORD MAP.
   Upon compliance with the terms and provisions of C. O. 911.02, the owner of land shall then submit a map for record and four (4) prints thereof to the Planning Commission. The original copy shall be drawn on tracing cloth in waterproof ink, scaled at not more than one hundred (100) feet per inch, and shall indicate the following thereon:
   (a)    The name of the subdivision with general location description shown in the title of same.
   (b)    A registered surveyor's certification as to accuracy over his signature and seal.
   (c)    The scale of the drawing and directional point.
   (d)    Accurate dimensions and bearings (or angles) of the subdivision boundary lines, showing all established monuments used in determining the boundaries as well as those set at boundary corners, etc.
   (e)    All streets and areas requiring future acceptance of dedication shall be shown in yellow shade or outline, with the names of the streets previously assigned by the Commission shown thereon.
   (f)    Accurate street center line dimensions and bearings, showing the locations of street monuments which shall be later set by the owner.
   (g)    Accurate dimensions and bearings on all sublot boundary lines including those along the street frontage and shall show sublots numbered consecutively.
   (h)   Show names of all owners whose undeveloped lands abut the subdivisions. These names shall be the latest placed on record.
   (i)    Show names of abutting recorded subdivisions with volume and page numbers as recorded, indicating abutting street locations as proposed or dedicated therein.
   (j)    Show all easement lines, with accurate dimensions and bearings on those covering sewer and/or water installations.
   (k)   Show easement lines (when applicable) for poles, conduits, etc.
   (l)    Show minimum building setback lines along all streets.
