(a) When an on-site wastewater treatment system is approved, subject to the condition that the property owner allow the Department to monitor the system, the property owner shall obtain an annual operating permit from the Director and have a valid operating permit in effect at all times.
(b) No person shall use or allow another person to use an on-site wastewater treatment system for which an annual operating permit is required if no operating permit is in effect at the time the system is used. A system that requires an annual operating permit, that is being operated without the permit being in force, shall be considered a defective system within the meaning of section 68.311(c), whether or not the system allows sewage, human excrement or other liquid wastes to be disposed of so that the waste is not confined underground.
(c) The Director may enter property during normal business hours to inspect an on-site wastewater treatment system that was approved subject to the condition that the Director would monitor the system.
