2101.02   POWERS OF AGENCY.
   The City, known and conducting itself as the Parma Public Housing Agency, and acting by and through its Council and officers, having been granted all powers of local self-government by the Constitution of the State, has and reserves to itself the power and authority to clear, plan and rebuild slum areas within the City and to provide safe and sanitary housing accommodations to families of low income. In order to accomplish those purposes, the City, by way of illustration and not of limitation, may:
   (a)   Sue and be sued; have a seal; have corporate succession; receive grants from State, Federal or other governments or from private sources; and conduct investigations into housing and living conditions;
    (b)   Determine what areas constitute slum areas; prepare plans for housing projects; purchase, lease, sell, exchange, transfer, assign or mortgage any property, real or personal, or any interest therein, or acquire the same by gift, bequest or eminent domain; own, hold, clear and improve property; provide and set aside housing projects, or dwelling units comprising portions of housing projects, designed especially for the use of families, the head of which or his or her spouse is sixty-two years of age or older, or for families as that term is defined under the United States Housing Act of 1937, as amended; engage in or contract for the construction, reconstruction, alteration or repair, or both, of any housing project or part thereof; administer housing programs; plan and replan streets, alleys and other public places or facilities in connection with any area or project; borrow money upon its notes, debentures or other evidences of indebtedness, and secure the same by mortgages upon property held by it, or by pledge of its revenues, or in any other manner; and invest any funds held in reserves or sinking funds or not required for immediate disbursements; and
    (c)   Borrow money or accept grants or other financial assistance from the Federal government for or in aid of any housing project within the City; take over, lease or manage any housing project or undertaking constructed or owned by the Federal government; and comply with such conditions and enter into such mortgages, trust indentures, leases or agreements as are necessary, convenient or desirable.

2101.03   COUNCIL AS GOVERNING BOARD; POWERS AND DUTIES.
    Council is and shall be the governing board of the Parma Public Housing Agency. All of the powers of the Agency which are legislative in nature shall be exercised and performed by Council. By way of illustration and not limitation, Council shall have the following powers and duties:
   (a)   To authorize the filing of suits; to adopt a seal; to authorize and direct the receipt of grants; to enter any building or property to conduct its investigation; and to conduct examinations and subpoena and require the attendance of witnesses and the production of books and papers, in connection with which powers, the Presiding Officer may administer oaths, take affidavits and issue subpoenas;
   (b)   To determine what areas of the City constitute slums; to authorize and direct the preparation of plans for housing projects; to authorize and direct the purchase, lease, sale, exchange, transfer, assignment or mortgage of any real or personal property, or any interest therein, or to authorize and direct the acquisition of the same by gift, bequest or eminent domain; to authorize and direct the improvement of property; to provide for and set aside housing projects, or dwelling units comprising portions of housing projects, designed especially for the use of families, the head of which or his or her spouse is sixty-two years of age or older, or for families as that term is defined in the United States Housing Act of 1937, as amended; to authorize and direct contracts for the construction, reconstruction, alteration or repair of any housing project or part thereof; to authorize and direct the lease or operation, or both, of any project, and to establish or revise schedules of rents for any projects or parts thereof; to authorize, direct and approve the planning and replanning of streets, alleys and other public places or facilities in connection with any area or project; to authorize and direct the borrowing of money upon notes, debentures or other evidences of indebtedness, and secure the same by mortgages upon property of the City, or by pledge of its revenues, or in any other manner; to authorize and direct the investment of any funds held in reserves or sinking funds or not required for immediate disbursements; and to make, amend and repeal bylaws, rules and regulations to carry into effect its powers and purposes; and
   (c)   To authorize and direct the borrowing of money or acceptance of grants or other financial assistance from the Federal government for or in aid of any housing project within the City; to authorize and direct the takeover, lease or management of any housing project or undertaking constructed or owned by the Federal government; and to comply with such conditions in mortgages, trust indentures, leases or agreements as are necessary, convenient or desirable.

2101.04   DIVISION OF PUBLIC HOUSING.
   (a)   There is hereby established within the Department of Public Service a division to be known as the Division of Public Housing. It shall consist of a Director and such other employees as may be necessary, all of whom shall be appointed by the Director of Public Service.
   (b)   The purpose of the Division, at the direction of its Director and under the supervision of the Mayor and the Director of Public Service, shall be to exercise and perform all powers and duties of the Parma Public Housing Agency which are executive in nature. To the extent that it has been authorized and directed to do so by Council, the Division shall construct, rehabilitate, equip, maintain, operate, administer and lease facilities for housing of elderly persons and persons of low and moderate income, and appurtenant facilities. To facilitate those functions, it shall have the power and authority to:
      (1)   Apply for and facilitate the receipt of grants from State, Federal or other governments, or from private sources; conduct investigations and studies of housing and living conditions; and enter any building or property in order to conduct investigations;
      (2)   Prepare and submit to Council studies of what areas of the City constitute slums; prepare and submit plans for housing projects; effectuate the purchase, lease, sale, exchange, transfer, assignment or mortgage of any property, real or personal, or any interest therein, or the acquisition of the same by gift, bequest or eminent domain; lease, administer or operate any project; and prepare and submit to Council proposed planning or replanning of streets, alleys and other public places or facilities in connection with any area or project; and
      (3)   Effectuate compliance with such conditions, mortgages, trusts, indentures, leases or agreements as have been authorized and directed by Council.
   (c)   In the performance of the duties of the Division, the Director of Public Service, to the extent authorized by Council, shall engage in or contract for the construction, reconstruction, alteration or repair, or both, of any housing project or part thereof; include in any contract let in connection with a project, stipulations requiring that the contractor and any subcontractor comply with the requirements as to minimum wages and maximum hours of labor, and comply with any condition which the Federal government has attached to its financial aid of the project; and execute contracts and all other instruments necessary or convenient to the exercise of the powers of the Parma Public Housing Agency on its behalf. With respect to such powers, including the power to contract, the Director of Public Service may authorize, in writing, the Director of the Division to exercise all or part of his or her authority in his or her name and on his or her behalf.

2101.05   OFFICERS.
   The Mayor, President of Council, Auditor, Treasurer, Director of Law, Director of Public Service and Director of Public Safety shall perform the same duties and functions assigned to them by Title Seven of the Ohio Revised Code for and on behalf of the Parma Public Housing Agency and, as such, shall serve as officers of the Agency, except however, the City Council may appoint one of its own members to be the Chairman of the Board of the Parma Public Housing Agency. A person holding any such office or a person serving as a member of Council shall not, by reason of performing any duties or functions described in this chapter, be deemed to be holding an additional or different public office and shall not thereby be disqualified from continuing in office.

2101.06   PERSONNEL POLICIES.
   Chapter 173 of the Administrative Code is hereby incorporated as the Parma Public Housing Agency's formal statement of personnel policies.

2101.07   PROCUREMENT POLICY.
   The Commissioner of the Division of Public Housing of the City is authorized and directed to promulgate and implement a procurement policy for the Parma Public Housing Agency, a copy of which is attached to Housing Ord. No. 06-2, passed January 23, 2006, in compliance with the Department of Housing and Urban Development regulations.
