718.02   LICENSE REQUIRED.
   No person shall operate any concession or amusement ride at any fair or carnival within the City of Parma without first obtaining a license as provided in this chapter.

718.03   LICENSE APPLICATION, FEE, BACKGROUND CHECK, ISSUANCE.
   (a)   Any person wanting a license shall obtain an application for same from the office of the Director of Safety, and shall submit the completed application, along with a valid driver's license or identification card issued by the State of Ohio or any other state for inspection and copying, on a form provided by the Director, which shall contain, at a minimum, the following information:
      (1)   Name, address, date of birth, and social security number of the applicant;
      (2)   Name and address of the organization represented;
      (3)   A description of the proposed concession, carnival, or fair;
      (4)   A complete and accurate list of all persons, carnival and concession workers who are or will be employed by or at any concession or amusement ride. Said list shall accurately state the name, address, date of birth, and social security number of all employees or carnival or concession workers who will be employed at the fair or carnival by the licensee.
   (b)   Each applicant shall pay a non-refundable fee of one hundred dollars ($100.00) per license plus an additional ten dollars ($10.00) for each employee named on the application, which shall be paid at the time the application is submitted.
   (c)   The Director of Safety shall provide the list to the Chief of Police who shall cause a felony warrant and sex offender background check to be conducted on the applicant and all persons listed by the applicant as employees or carnival or concession workers.
   (d)   All license applications shall be referred to the Director, or his or her designee, who shall, within 72 hours after receipt of the completed application, issue the license, unless the Director finds that:
      (1)   The applicant has provided false information in his or her application;
      (2)   The applicant named on the license application or any person or carnival worker or concession worker named on the license application has been convicted of or found guilty of any felony level sex offense contained within Ohio R.C. Chapter 2907;
      (3)   The applicant named on the license application or any person or carnival worker or concession worker named on the license application has been convicted of or found guilty of any felony contained within Ohio R.C. Chapter 2903;
      (4)   The applicant named on the license application or any person or carnival worker or concession worker named on the license application has been convicted of or found guilty of domestic violence as defined in Ohio R.C. 2919.25(A) and (B) within the past ten years;
      (5)   The applicant named on the license application or any person or carnival worker or concession worker named on the license application has been convicted of or found guilty of any crime(s) not listed above evaluated at the discretion of the Safety Director and Chief of Police; or
      (6)   The applicant named on the license application is not in compliance with the terms of this chapter.

718.04   PHOTO IDENTIFICATION REQUIRED, DISPLAY.
   (a)   Every operator, carnival worker, and concession worker shall obtain a photo identification badge from the Parma Police Department.
   (b)   Every operator, carnival worker, and concession worker shall at all times while on duty prominently display the issued photo identification badge.

718.05   NON-LISTED EMPLOYEES, PROOF.
   (a)   No licensed operator shall employ any person or carnival or concession worker who has not been listed by the licensee on the license application provided for in Section 718.03.
   (b)   Within 24 hours of a request by the Chief of Police or any law enforcement officer, any applicant or licensed operator shall provide proof to the Director of Safety that an employee, carnival or concession worker has been listed in accordance with Section 718.03(a)(4).

718.06   TERM, DISPLAY.
   Upon approval of the license application by the Director of Safety, the Director shall issue a license. Such license shall be displayed by the operator in a prominent location at the fair or carnival, and shall be valid during the term issued.
