141.01   COMPOSITION OF DEPARTMENT.
   The Department of Public Safety shall be composed of the Director of Public Safety, such other employees as Council may from time to time designate and as are set forth in the annual salary ordinance.

141.02   SERVICE INSPECTOR (ANIMAL WARDEN AND HEALTH OFFICER).
   (a)   There is hereby established in the Department of Public Safety the position of Service Inspector, who shall also be known as the Animal Warden and Health Officer.
   (b)   The duties of the Service Inspector shall be, generally, to enforce all animal ordinances and health ordinances of the City, as well as any and all inspection duties prescribed to him or her by the Director of Public Safety.
   Among other duties, it shall be the duty of the Service Inspector to apprehend any animal running at large in the City and dispose of the same according to the provisions of Section 618.25 of the General Offenses Code. Upon the impounding of any animal, it shall be the duty of the Service Inspector to make a repot in detail to the Director of Public Safety showing the registry, breed, color and sex of the animal impounded, and whether or not such animal is licensed. If such animal is licensed, the Service Inspector shall enter into the report the name and address of the owner of such animal and the number of the license tag.
   (c)   It shall be the duty of the Director of Public Safety to collect and assess all fines for the redemption of any animal so taken and to release such animal upon payment of the assessments provided for in Section 618.25.
   (d)   The Service Inspector shall be deputized by the Director of Public Safety to issue citations and to make arrests within his or her jurisdiction and shall be provided with suitable identification.

141.03   DISQUALIFICATION FOR APPOINTMENT.
   (a)   Notwithstanding any provision of Ohio R.C. 124.27 or Rule VII of the Civil Service Rules to the contrary, the Director of Public Safety may decline to appoint any one or all of the three persons certified to him or her as eligible for original appointment to a within rank position in the Divisions of Police and Fire when it appears to him or her that any such certified eligible, for disqualifying reasons discovered as a result of administration of a polygraph test or otherwise, should not be so appointed.
   (b)   Any disqualifying reason used by the Director as the basis for declining to appoint a certified eligible must meet all the following criteria:
      (1)   The reason shall be expressly stated, in writing.
      (2)   Notice of the Director's action, including the specific reasons therefor, shall be sent to the certified eligible and the Civil Service Commission within three days of such action being taken.
      (3)   The reason must be supported by credible evidence that the certified eligible has committed acts which demonstrate character traits which would be detrimental to successful performance as a police officer or firefighter.

   (c)   The Director shall request, and the Civil Service Commission shall provide, the names of such additional eligibles as are needed to replace any certified eligible the Director has declined to appoint pursuant to this section.

141.04   CRIMINAL BACKGROUND CHECKS OF SCHOOL GUARDS; DISQUALIFICATION.
   (a)   The Chief of Police is hereby directed to perform criminal background checks as lawfully permitted upon all individuals who are to be school guards in the City. This requirement shall apply regardless of whether the individuals involved are volunteers or paid personnel. The Chief of Police shall forward the background check to the Director of Public Safety.
   (b)   The Director of Public Safety shall utilize the application form for employment and the release form for the criminal background check in the selection of any person to become employed as a school guard, regardless of whether these individuals are volunteers or otherwise. Release of any information contained in the application form and information contained in any background check shall be governed by the provisions contained in Ohio R.C. 149.43, as the same may be amended from time to time.
   (c)   The Director of Public Safety shall utilize the following guidelines to determine whether an individual is qualified to be employed as a school guard for the activities described in this section:
      (1)   An individual is automatically disqualified from employment as a school guard if he or she has been convicted of or found guilty of any felony level sex offense contained within Ohio R.C. Chapter 2907 if that conviction occurred within the past ten years.
      (2)   An individual is automatically disqualified from employment as a school guard if he or she has been convicted of or found guilty of any felony within Ohio R.C. Chapter 2903 if that conviction occurred within the past ten years.
      (3)   An individual is automatically disqualified from employment as a school guard if he or she has been convicted of or found guilty of domestic violence as defined in Ohio R.C. 2929.25(A) and (B) within the past ten years.
   (d)   The applicant will have the right to appeal the decision of the Director of Public Safety. All appeals will be decided upon by the Mayor. The Mayor's decision shall be final.
   (e)   The release form to be completed by all applicants for criminal background checks for the position of school guard is as shown in Exhibit A.
