(a) Scope. This section sets forth the Department's policy with respect to adjudications.
(b) Definitions. The following term shall, for purposes of this section and as used elsewhere in the rules, have the meaning shown herein.
OATH. New York City Office of Administrative Trials and Hearings.
(c) Adjudications. Pursuant to Section 1043 of the Charter, the Department designates OATH as the forum for adjudication of any matters requiring adjudication. The OATH administrative law judge shall submit to the Fire Commissioner the record of the hearing conducted in the matter and a written report of the hearing, including proposed findings of fact and conclusions of law, a recommended decision and, if applicable, a recommended penalty. The Fire Commissioner shall render the final determination of the matter.
