An approved agency shall employ experienced personnel qualified to conduct, supervise and evaluate the tests or inspections that it undertakes. Special inspections may be performed only by employees of such agency who are special inspectors qualified pursuant to department rules to perform or witness the particular test or inspection. The commissioner may require proof of the qualifications of employees.
The commissioner may disqualify an approved agency or inspector from performing inspections pursuant to this code for cause. The approved agency or inspector shall be given prior notice of the proposed disqualification and the opportunity to contest such action. A list of approved agencies and inspectors who have been disqualified from performing inspections shall be maintained and made available to the public on the department's website.
