In this Article, the following words have the meanings indicated:
(1) Handicapped means a physical, mental, or emotional impairment of any person that substantially limits one or more major life activities.
(2) Licensee means a person or organization:
(A) Licensed to operate a group residential care facility under Chapter 23A; or
(B) Whose residential care facility does not require a license under Chapter 23A, but whose program has been approved by the Director of Health and Human Services under Section 23A-4.
(3) Supporting services means services available based on assessed need for:
(A) Counseling;
(B) Protective services to adults;
(C) Housing improvement services;
(D) Health-related services, including personal care;
(E) Housekeeping and shopping assistance;
(F) Social participation and chore services;
(G) Home-delivered meals; and

A regulation that implements a function assigned to the Department of Health and Human Services by 1995 LMC ch. 13 continues in effect but is amended to the extent necessary to provide that the regulation is administered by the Director of the Department of Health and Human Services."
