A. Permit Required; Application: No licensed house mover 1 or other person shall move any building over any street or alley without first securing a permit for such removal as in this section provided and a fee as established from time to time by resolution of the city council paid. Written application for such permit shall be presented to the building official, which application shall show:
1. Name of the applicant.
2. Name of owner of building.
3. Legal description of lot on which building has been located and also that of the lot to which it is to be moved.
4. Route along which it is proposed to move said building.
5. Time when such removal is made.
6. Dimensions of such building.
Such application shall be accompanied by a certificate of the director of public works approving the proposed route as set out in such application.
B. Issuance Of Permit:
1. The building official shall examine such written application, and if he finds that such building can be so moved along the proposed route without damage to the city or any property owner and the applicant is a licensed house mover as shown by the records in his office, he shall file such application with the finance officer and issue to the applicant a written permit, designating the route along which such building shall be moved, the methods, tools and appliances to be used in making such removal and date on which such removal is to be completed.
2. If the building is of modular construction heretofore approved by the city council, to be used as a new residence, the building official may cause said permit to be issued without further hearing or notice, to be moved to any lot approved by the building official. However, the building official shall have authority to require a hearing as hereinafter set forth.
3. If the building is not of new construction, and the building is to be moved to any location within the city, no permission shall be granted until after a hearing on such application, which hearing shall be at a regular meeting of the city council and after five (5) days' notice of such hearing has been given by the building official by posting of not less than one sign of at least nine (9) square feet in area with a white background and black letters at least three inches (3") high, containing notice of hearing, in a conspicuous place on or near the property to which the application is made to move such building. C. Deposit Or Bond Required: Before the issuance of a permit, the applicant for such permit shall first deposit with the finance officer cash or surety bond as shall be deemed adequate by the city council, pursuant to resolution, with such deposit or surety conditioned upon the applicant complying with all of the provisions of this code and other ordinances of the city concerning the placing of the building in a condition of compliance to or with all such provisions. It shall be unlawful for any person to move any building into or within the city unless the building shall have been inspected and approved by the building official for compliance with the building code and with the plumbing code. The fee for such inspection of each building shall be as established from time to time by resolution of the city council. (1984 Code § 16-8)
A. Protection Of Pavement: Any person moving any house or building over or across any street shall, when so provided in the permit, cause such street to be protected by laying planks thereon. (1984 Code § 16-9)
B. Injuring Or Moving Utility Poles, Wires And Trees: Nothing in any license or permit granted shall be construed as authorizing the holder thereof to break, injure or move any telegraph, telephone or electric light poles or electric line wires or in any way injure shade trees or other property without permission from the owner thereof. (1984 Code § 16-10)
C. Obstructing Street Or Railway: No building or part of a building shall be allowed to stand still in any public street for more than twenty four (24) consecutive hours, except with written consent of the superintendent of streets, and no building shall be allowed to obstruct any railway except with the consent of the railway company. (1984 Code § 16-11)
D. Permission To Alter Trees And Plants: No person moving any building shall cut down or trim any trees or disturb any shrubbery, flowers or grass or use the parkings or break off any branches of any tree along any street without the permission of the director of park and recreation.
