Whenever any vacancies shall occur in any manner whatever in any of the offices provided for in this chapter, the village president and board of trustees shall fill such vacancy at their next regular meeting, unless the interests of the village require it to be done sooner, in which event the village president or any two (2) members of the board may call a special meeting for that purpose. (1904 Code § 29.13)
A. The village president and board of trustees may establish and fix the amount of salary to be paid any and all village officers as the case may be, except members of such legislative body, in the annual appropriation bill or ordinance made for the purpose of providing for the annual expenses of the village, or by some ordinance prior to the passage of such annual appropriation bill or ordinance; and the salaries or compensation thus fixed or established shall neither be increased nor diminished by such legislative authority during the year for which such appropriation is made, and no extra compensation shall ever be allowed to any such officer or employee over and above that provided in the manner aforesaid, except as otherwise provided by ordinance.
B. Compensation of certain village officers shall be as follows:
1. The village president shall receive as compensation the sum of ten thousand dollars ($10,000.00) per year. In addition, the village president shall be reimbursed for his/her telephone expenses.
2. Each member of the board of trustees shall receive as compensation for his/her services the sum of sixty dollars ($60.00) for each meeting of the board of trustees attended by him/her, and the sum of twenty five dollars ($25.00) for each committee meeting of the board of trustees attended by him/her.
3. Each member of the planning and zoning commission shall receive as compensation for his/her services the sum of thirty five dollars ($35.00) for each meeting of the planning and zoning commission attended by him/her. (Ord. 2017-06, 2-28-2017)
It shall be the duty of the village clerk:
A. To attend all meetings of the board of trustees.
B. To keep a full record of the board's proceedings in the journal of the board.
C. To record in a book to be kept for that purpose all ordinances which are passed by the board.
D. To post in three (3) public places in the village copies of such ordinances as are required by law to be published, within ten (10) days after the passage thereof, or cause the same to be published in pamphlet form, or in some newspaper of general circulation published in the village.
E. To make at the foot of the record of each ordinance a memorandum of the date of its passage and of publishing or posting thereof.
F. To keep and safely preserve all papers, books and documents pertaining to his office.
G. To have the custody and charge of the corporate seal and all papers, books, maps and documents belonging to the village when not in actual use by some village officer.
H. To deliver, without delay, to the village president and board of trustees all communications and documents addressed to the same which may come to his hands.
I. To provide, at the expense of the village, all necessary books and stationery for the use of the village president and board of trustees.
J. To keep a correct account between the village and the treasurer by charging the treasurer with all monies received by him as shown by his duplicate receipts accompanying the treasurer's monthly reports, and crediting him with all monies paid out by him by order of the village president and board of trustees, and such other credits as he may be entitled to by law and the village ordinances.
K. To make out and countersign all warrants drawn upon the treasurer by order of the village president and board of trustees, and keep in his office memoranda thereof showing the date of each order, the amount, in whose favor and for what purpose the same was drawn.
L. To perform such other acts in addition to the above as are now or hereafter may be required of him by the ordinances of the village or resolution of the village president and board of trustees. (1904 Code § 29.3)
It shall be the duty of the village treasurer:
A. To receive all monies belonging to the village, and to keep correct and true account of the same in an intelligible manner, showing when and for whom and on what account received, and when, to whom and on what account paid out, keeping a separate account of each fund or appropriation, and the debits and credits belonging thereto.
B. To give every person paying money to the treasury a receipt therefor specifying the date of payment and upon what account paid, copies of which receipts he shall file with the village clerk at the date of his monthly reports.
C. To render to the village president and board of trustees at each regular monthly meeting of the same a report, under oath, showing the state of the treasury at the date of such report and the balance of money in the treasury, which report he shall accompany with a detailed statement of all monies received into the treasury from the date of the preceding monthly report, together with all warrants redeemed and paid by him, which warrants he shall stamp or mark "paid", and he shall deliver the same with any and all other vouchers held by him to the village clerk upon every day of such settlement to be filed in the clerk's office.
D. To pay out all monies that may be ordered by the board of trustees, upon warrants signed by the village president of the board and countersigned by the village clerk, and keep a register of all warrants redeemed and paid describing such warrants by showing the amount, number, the fund from which paid, of each warrant and the name of the person to whom paid, and when paid.
E. To, annually between May 1 and May 10, make out and file with the village clerk a full and detailed statement or account of all receipts and expenditures of the village as shown by the books of his office, up to the date of the statement, and of all his transactions as village treasurer, and shall show in such account the state of the treasury at the close of each fiscal year, which account the clerk of the village shall immediately post in place of holding meetings of the board of trustees.
F. In addition to the duties herein enumerated, the village treasurer shall perform such other duties as now are, or hereafter may be, required of him by ordinance of the village or by the laws of the state. (1904 Code § 29.4)
A. The duties of the village attorney shall be:
1. To prepare such ordinances as the same may be requested by the village board or any of its members.
2. To confer with and advise the village board or any of its members on any legal matters.
3. To prosecute violations of its ordinances and in general to do everything in and about the premises as may be designated from time to time by the village board. (Ord. 1931-1, 5-8-1931)
B. The salary of the village attorney shall be established by the village board. (1977 Code; amd. 1997 Code)
