7-4-1: PURPOSE AND AUTHORITY:
   A.   The city council of the city of Melba recognizes the city park is for the use and enjoyment of all citizens of Melba; and
   B.   The city council desires to provide for the orderly use of public property, while also protecting health, safety and general welfare of all its citizens; and
   C.   The city has authority and supervision over the use and control of the city park under Idaho Code sections 50-313 and 50-314. (Ord. 241, 12-10-2012)
7-4-2: HOURS:
   A.   No person shall use, enter, or occupy the premises of the city park for any purpose after dusk or before dawn of any day. "Dusk" shall be defined as thirty (30) minutes after sunset and "dawn" shall be defined as thirty (30) minutes before sunrise.
   B.   There shall be no parking of any type of motor vehicle or trailer in a city park after dusk or before dawn of any day. "Dusk" and "dawn" shall have the same meaning as in the preceding subsection. Violating vehicles may be towed at owner's expense. Persons using, entering, or occupying the premises of the city park pursuant to special event permits that extend past dusk or begin before dawn are exempt from this regulation.
   C.   Law enforcement, other safety personnel, city officials and city employees, when acting in an official capacity are exempt from this regulation. (Ord. 241, 12-10-2012; amd. Ord. 282, 10-10-2022)
7-4-3: POSSESSION OR CONSUMPTION OF ALCOHOLIC BEVERAGES:
It shall be unlawful for any person, association, corporation or other entity to sell, distribute, possess or consume any type of alcoholic beverage within the premises of the city park. (Ord. 241, 12-10-2012)
