TOWING OF UNAUTHORIZED VEHICLES

7-5-1: TOWING AUTHORIZED:
   A.   Towing Authorized; Contract for Towing: The City may contract with a towing company (hereinafter referred to as "towing company") for the purpose of towing vehicles or trailers pursuant to this chapter and City Code.
      1.   Upon contracting with a towing company, the City may post signs on City property identifying the tow company the City has contracted with for the purpose of towing vehicles or trailers parked in violation of City code.
   B.   Authority of Towing Company: The towing company shall only be authorized to tow a vehicle or trailer pursuant to this chapter upon request of an authorized City official, which may include the mayor, city clerk, code enforcement officer, police officer, or county sheriff deputy. The vehicle or trailer may be towed to a place of safety as designated by the City, or may alternatively be towed to a place of storage under the control of the tow company.
   C.   Parking Citation Not Required: A parking citation is not required to be issued in order for the City to tow, or have towed, a vehicle or trailer pursuant to this article.
   D.   Lien Against Towed Vehicle: Upon performing an authorized tow, a tow company may obtain a possessory lien on the vehicle or trailer in accordance with state law related to possessory liens. (Ord. 2022-10-7, 10-10-2022)
7-5-2: NOTICE OF TOW:
   A.   Notice Required: Upon performing a tow, the towing company shall send notice to the registered owner of the towed vehicle or trailer at the address on file with the Department of Transportation. Notice shall be sent by certified mail within forty-eight hours, excluding weekends and holidays.
   B.   Content: The notice shall include the following:
      1.   Inform the owner that the vehicle or trailer has been towed pursuant to the applicable City Code and this chapter.
      2.   Identify the vehicle or trailer by make, model year, model, identification number, license plate number, mileage, and state of registration.
      3.   The name and telephone number of the towing company that performed the tow;
      4.   The date and time of the tow;
      5.   Identify where the vehicle or trailer was removed from and where it is currently located;
      6.   Describe the requirements for retrieving the vehicle or trailer from impound (if impounded).
      7.   State that the vehicle or trailer can be sold for tow and storage charges, and unpaid parking fines, if not claimed within thirty (30) days from the date of mailing of the notice.
      8.   Describe the procedure for obtaining a hearing. (Ord. 2022-10-7, 10-10-2022)
