1355.03 INSURANCE REQUIRED FOR TRAVERSING PUBLIC GROUND.
Before any permit for moving any structure or building across any sidewalk, street, highway or public place within the City limits shall be issued, the applicant or his agent shall furnish an insurance policy, in an amount of one hundred thousand dollars ($100,000) for injury or death to one person, three hundred thousand dollars ($300,000) for injury or death to more than one person and one hundred thousand dollars ($100,000) property damage. The insurance policy shall provide that the City be named as insured and further that the applicant and his insurer shall hold the City harmless against any liabilities, judgments, damages, costs and expenses which may in any wise accrue or arise against the City in consequence of the granting of such a permit or the performance of any work pursuant thereto.
1355.04 PERMIT LIMITATIONS.
The following limitations shall apply on the use of a building moving permit:
(a) The granting of a permit does not guarantee that the load described can be moved without damage to the pavement or structures although the permit is granted on the assumption that the load can be moved without damage, based on the best information available. The permittee shall be held liable for any and all damage caused by the movement. The City assumes no responsibility for damage to the permittee's equipment or load being moved due to any such failure. The permittee agrees to hold the City harmless from all claims, damages or proceedings of any kind, and from all responsibility for personal or property damages (public or private) caused directly or indirectly as a result of the transportation of such vehicles or objects.
(b) The permit shall be in the possession of the driver at all times during the progress of transportation and will be shown on demand to any police officer or City official.
(c) The permission granted restricts the movement of the vehicles or objects to the streets specified between the points designated and within the time allotted.
(d) No vehicle or building shall be left parked on the roadway either day or night, except in case of an emergency, in which case adequate protection shall be provided for the traveling public at the expense of the permittee.
(e) The operator of the vehicle must comply with all laws, rules or regulations covering the movement of traffic over streets and with reductions of legal weight posted on roadways or bridges.
(f) A permit is void at any time when road, weather or traffic conditions make travel unsafe.
(g) A permit will not be issued for built-up loads that are divisible into legal loads.
(h) Oversize or overweight loads shall be operated or moved at such speeds and in such a manner as to cause a minimum of interference with other traffic and minimum impact stresses on structures and pavements.
(i) Loads having extremely large dimensions shall require additional protective measures when necessary for the safeguarding of other traffic. Due regard shall be taken of traffic in both directions, and every possible effort shall be made to prevent traffic congestion. Red flags, one or more flagmen or a pilot car may be required.
(j) Noncompliance with the general or special provisions of a permit, exceeding the weights or dimensions granted, or operating on dates or upon streets other than assigned, shall render the permit null and void and the operator of the vehicle subject to arrest.
(k) Within thirty days after issuance of the permit, the structure or building must be moved or the permit will be void, unless an extension of time is granted by the Director of Public Works because of an act of God or events fully beyond the control of the permittee.
1355.05 BASEMENT; SEWERS AND UTILITIES.
Within seventy-two hours after any part of the structure or building has been removed from its foundation, the basement area shall be filled and the surface graded and cleared of all building material and debris.
Also, within such seventy-two hour period, all utilities and sewers are to be shut off and/or plugged. Such utilities and sewers shall be plugged either at the inspection test tee, curb line or the building foundation line at the discretion of the Director of Public Works.
1355.06 BOND FOR EXPENSE TO CITY.
Before a permit to move a structure or building is issued, a cash bond of two thousand five hundred dollars ($2,500) shall be deposited with the City to cover any minor damage to City or private property or additional fees incurred during the move. If such damage or fees exceed two thousand five hundred dollars ($2,500), the permittee shall be fully liable for same. Such cash bond is to be deposited with the Director of Finance. Any unused portion of such cash bond shall be released when the permittee has complied with all of the provisions of this chapter.
1355.99 PENALTY.
Whoever violates any provision of this chapter is guilty of a misdemeanor of the fourth degree. Any such violation shall constitute a separate offense on each successive day continued.
