   1161.07 PUBLIC HEARING BY COUNCIL.
   Upon receipt of the Planning Commission's recommendation, the Clerk of Council shall set a date for a public hearing. Notice of the public hearing shall be given by the Clerk of Council by at least one publication in one or more newspapers of general circulation in the City. Such notice shall be published at least thirty days before the date of the required hearing. The published notice shall set forth the date, time and place of the public hearing, and a summary of the proposed amendment. A sign shall be placed upon the property under consideration stating the nature of the rezoning and the date, time and place of the public hearing. In the event that more than one lot is proposed for rezoning, one sign shall be prominently displayed stating the above information and adequately describing the lots to be considered for rezoning.

   1161.08 NOTICE TO PROPERTY OWNERS BY COUNCIL.
   If the proposed amendment intends to rezone ten or less parcels of land, as listed on the tax duplicate, written notice of the hearing shall be mailed by the Clerk of Council at least twenty days before the date of the public hearing, to all owners of property within, contiguous to and directly across the street from such area proposed to be rezoned. The failure to deliver such notification shall not invalidate any such amendment.

   1161.09 ACTION BY COUNCIL.
   Within sixty days after the public hearing required by Section 1161.07, Council shall either adopt or reject the recommendation of the Planning Commission or adopt some modification thereof. In the event Council rejects or modifies the recommendation of the Commission, it shall do so by not less than three-fourths of the full membership of Council. No ordinance amending the Zoning Code or Map shall be deemed to pass or take effect without the concurrence of at least a majority of the full membership of Council.

   1161.10 FAILURE OF PLANNING COMMISSION TO REPORT; FAILURE OF COUNCIL TO ACT.
   Failure of the Planning Commission to make its report to Council within thirty days shall be deemed to be their approval of the amendment, supplement or change. Failure of Council to take final action upon the proposed amendment, supplement or change within sixty days after the public hearing shall be deemed to be a rejection of the ordinance.

   1161.11 RESUBMITTAL OF APPLICATION FOR AMENDMENT.
   In the event the proposed amendment, supplement or change to this Zoning Ordinance or Map has been disapproved by Council, no application for a proposed identical amendment shall be resubmitted for a period of sixty days.
