   977.01 DEFINITIONS.
   (a)   "Garbage", as herein used, means all kitchen refuse, vegetable or animal matter, as may decompose, or become dangerous or offensive to the public health.
   (b)   "Rubbish", as herein used, means all waste matter such as ashes, cinders, cans, glass, porcelain, and crockery.
   (c)   "Recyclables", as herein used, means aluminum cans, tin cans, clear glass containers, colored glass containers, #1 and #2 plastic containers, and newspapers.
   (d)   "Yard waste", as herein used, means grass, leaves, brush, and garden and flower debris. (Ord. 00-036. Passed 2-15-00.)
   977.02 COLLECTION REQUIREMENTS.
   (a)   Every owner and person having control of any building, premises or place of business in the City shall provide, or cause to be provided, and hereafter at all times shall keep or cause to be kept, proper receptacles for receiving and holding all garbage and rubbish that may accumulate upon or within such building, premises or place of business.
   (b)   Unless otherwise permitted in this chapter, receptacles for garbage and rubbish shall be watertight plastic bags of not more than thirty-three gallon capacity. Plastic bags may be placed in thirty-three gallon capacity containers with tight-fitting lids and two handles or bail.
   (c)   Every owner and every person having control of any building or premises used for residential purposes, including multiple family dwellings, shall provide and insure that garbage and rubbish shall be removed from such building or premises not less than once each week by the City Sanitation Division, a licensed private commercial garbage and rubbish collector or such other method as may be approved by the Director of Public Service in accordance with recognized health and sanitary standards and regulations.
   (d)   Every owner and every person having control of any building or premises used for business, commercial or industrial purposes shall provide and insure that garbage and rubbish are removed from such building or premises as frequently, but not less than once each week, as may be determined by the Director of Public Service to be necessary in accordance with recognized health and sanitary standards and regulations, and such removal is accomplished by the City Sanitation Division facilities, a licensed private commercial garbage and rubbish collector or such other methods as may be approved by the Director in accordance with recognized health and sanitary standards and regulations.
   (e)   The failure of any licensed private commercial garbage or rubbish collector to remove and dispose of garbage and rubbish from the building or premises of one of its customers in accordance with subsections (c) or (d) hereof shall be cause for revocation of any license issued for collecting, removing, hauling or transporting garbage or rubbish on or upon any street, alley or public way of the City.
   (f)   Refuse shall not be placed for collection earlier than 6:00 p.m. on the day before scheduled collection and no refuse or containers shall remain at curbside for more than twenty-four hours. (Ord. 00-79. Passed 3-21-00.)
   977.03 UNLAWFUL DUMPING; EXCEPTIONS.
   (a)   No person shall place garbage or rubbish upon any lot, street, alley or public ground within the City. No garbage shall be moved or hauled over or through any of the streets or alleys within the City except:
      (1)   In the can or cans in which it was originally deposited; or
      (2)   In vehicles with watertight lids covering the same.
   (b)   No effluent of septic tanks shall be dumped at any location within the corporate limits of the City unless such location has been specifically authorized by the Service Director of the City. (Ord. 00-036. Passed 2-15-00.)
   977.04 BUSINESS LITTER RECEPTACLES.
   Any business which sells items that are to be eaten, consumed or used on or about the premises shall provide proper receptacles for litter upon such premises.
