977.99 PENALTY.

Whoever violates any provision of this chapter is guilty of a misdemeanor of the fourth degree for a first offense; and is guilty of a misdemeanor of the second degree for a second or subsequent violation. Prosecution shall always be as and for a first offense unless the affidavit upon which the prosecution is instituted contains the allegation that the offense is a second or repeated offense.
