505.01 PROHIBITING THE KEEPING OF WILD OR OTHER ANIMALS.
   (a)    No person shall keep, maintain or have in his possession or under his control within the City any of the following animals:
      (1)    Any animal which has been declared to be protected or endangered by the U.S. Department of Interior and/or the Ohio Revised Code.
      (2)    Any animal which is capable of secreting or injecting poisonous substances into the human body so as to cause serious harm or death.
      (3)    Any animal which is capable of restricting breathing or circulation in humans so as to cause serious harm or death by constriction.
      (4)    Enumerated members of the following orders and families:
         A.    Monotremata (echidna, platypus)
         B.   Marsupialia (bandicoot, brushtail, glider, kangaroo, koala, marsupial cats, monito, mulgara, numbat, oppossum, phalanger, possom, quokka, quell, rat kangaroo, Tasmanian devil, wallaby, wombat)
         C.   Insectivora (desman, hedgehog, mole, moonrat, shrew, solenodon, tenrec)
         D.   Chiroptera (bat, flying fox, myotif, noctule, pipistrelle, roulette, serotine)
         E.   Primates (aye-aye, ape, bush baby, chimpanzee, gibbon, gorilla, indri, femur, lords, monkey, orgauutan, potto, siamang, sifaka, tarsier)
         F.   Scandentia (tree shrew)
         G.   Dermoptera (flying femur)
         H.   Edentata (anteater, armadillo, sloth, tamandua)
         I.   Pholidota (pangolin)
         J.   Rodentia (acouchi, agouti, beaver, capybara, coypu, degu, gundi, hutia, marmot, mole-rat, muskrat, pace, pacarana, porcupine, prairie dog, rat, springhass, squirrel, tucotuco, viscacha, woodchuck)

         NN.    Any other dangerous animal. "Dangerous animal" includes any mammal, reptile or fowl which is not naturally tame or gentle, but is of a wild nature or disposition and which because of its size, vicious nature or other characteristics would constitute a danger to human life or property if it escaped from secure quarters. "Dangerous animal" also includes any domestic, reptile or fowl which because of its size or vicious propensity or other characteristics would constitute a danger to human life or property if it escaped from secure quarters.
   (b)    Subsection (a) hereof shall not apply to medical and educational institutions and duly licensed pet stores, if:
      (1)    Their locations conform to the provisions of the zoning ordinance of the City.
      (2)    All animals and animal quarters are kept in a clean and sanitary condition and so maintained as to eliminate objectionable odors and noise.
      (3)    Animals are maintained in quarters so constructed as to prevent their escape.
      (4)    No person lives or resides within 100 feet of the quarters in which the animals are kept.
   (c)    Subsection (a) hereof shall not apply to shows or exhibits duly licensed and approved by the Police Department. However, no permit shall be approved where it is proposed that spectators are to come into direct contact with wild animals as defined in subsection (a) hereof.
   (d)    Temporary possession of wild, native animals obtained through legal means for bird banding and other forms of scientific study shall not be restricted.
   (e)    Incapacitated animals can be possessed temporarily if they pose no threat to public health or safety and are reported to legal authorities for final disposition.
   (f)    Any person, firm or corporation failing to comply with any provision of this section is guilty of a misdemeanor of the fourth degree.
   Any person, firm or corporation failing to comply with any provision of this section, and having a prior conviction under this section, is guilty of a misdemeanor of the second degree. (Ord. 88-290. Passed 10-4-88.)
