8.04.010   Milk and milk products.
   A.   As used in this section, "Grade A pasteurized milk" and "Grade A pasteurized milk products" mean milk or milk products made from milk having a bacteria plate count not in excess of twenty thousand per milliliter or a coliform count not exceeding ten per milliliter and which milk or milk products are processed in compliance with the requirements for Grade A pasteurized milk and milk products as promulgated by the New Mexico Department of Health and Social Services' Regulations Governing the Grading and Grade Labeling of Milk and Milk Products, adopted by the state Board of Public Health on February 12, 1956, and subsequent amendments thereto.
   B.   No person shall sell or offer for sale within the city any milk or milk products except those qualifying as Grade A pasteurized milk or milk products. (Ord. 355 (part), 1988: prior code § 4-5-301)
8.04.020   Imported meat.
   A.   As used in this section, "imported meat" means all fresh, frozen or processed meat other than fish or poultry which originated in any state, nation or country outside the continental United States of America with the exception of Alaska, Hawaii, Puerto Rico and the Virgin Islands.
   B.   No person shall sell, offer for sale, display for sale or advertise for sale within the city any imported meat unless such meat shall be labeled as imported meat, and shall have been slaughtered, processed and handled in conformity with "The Wholesome Meat Act of 1967" as enforced by the U.S. Department of Agriculture. 8.04.030   Violation—Penalties.
   Any person violating Sections 8.04.010 or 8.04.020 of this chapter shall be deemed guilty of a misdemeanor and upon conviction thereof shall be fined not exceeding three hundred dollars or by imprisonment not exceeding ninety days or by both such fine and imprisonment. Each day such violation is committed or permitted to continue shall constitute a separate offense and shall be punishable as such hereunder. (Ord. 355 (part), 1988: prior code § 4-5-352)
8.04.040   Sale of fruits and vegetables.
   All merchants and dealers in berries, fruits and vegetables and other articles of human food that may ordinarily be eaten without cooking shall, at ail times while such merchandise is on sale, keep such berries, vegetables and food in a compartment or receptacle that is and may be kept absolutely free from the common housefly. 8.04.050   Sale of impure food prohibited.
   It is unlawful for any person to vend, sell or offer to sell any impure food of any description within the city. (Prior code § 7-3-12)
