Sec. 22.106. Cultural Affairs Commission.
 
   (a)   There is hereby created a “Board of Cultural Affairs Commissioners”, referred to in this chapter as the “Commission” or the “Board”.
 
   (b)   The Commission shall be comprised of seven members.
 
   (c)   The Commissioners shall be appointed and may be removed in accordance with Charter Section 502.
 
   (d)   The original seven members of the Commission shall be appointed for such terms as shall cause two terms to successively expire on the date of June 30 in two years, three years, and four years, and one term to expire in five years respectively, next following the effective date of the appointment of the original Board of Commissioners. The period of the term of each of the first seven members shall be designated in the appointment.
 
   Thereafter, the terms of succeeding members of the Commission shall be five years beginning with the first day of July following the expiration of the prior term.
 
   (e)   Organization and Meetings of the Commission.
 
   (1)   The Commission shall elect officers in accordance with Charter Section 503(a). The first appointed Commission shall elect interim officers from its members to serve as President and Vice-President until succeeded as provided above.
 
   (2)   The Commission shall hold a regular meeting at least once a month. All meetings of the Commission shall be in a municipal or other facility open to the public and there shall be reasonable provision for notice and attendance by the public. Each Commissioner shall be paid an attendance fee of $10.00 per meeting attended, not to exceed $100.00 in any calendar month to any one member.
 
   (3)   As required by Charter Section 503(a), the General Manager shall assign a Secretary to the Commission from among the employees of the Cultural Affairs Department. The duties of the Secretary shall be in addition to the regular duties prescribed for that employee, who shall be under the supervision of the General Manager or the General Manager’s designee.
 
   (4)   The Secretary shall perform those duties set forth in Section 21.4 of this Code and shall perform such other duties imposed by this article, or by the General Manager.
 
   (5)   Four members of the Commission must be present at any meeting in order to constitute a quorum, but a smaller number may adjourn from time to time until a quorum is present.
 
   (6)   The Commission may establish and empower a Committee, composed of two or three of its members, to consider matters for, to conduct hearings on behalf of, and make recommendations to, the Commission.
 
   (7)   The powers conferred upon the Commission shall be exercised by order or resolution adopted by a majority of the members and recorded in the minutes with “Ayes” and “Noes” at length. The minutes shall be attested by the signatures of the President or Vice-President, or two members of the Commission, and by the signature of the Secretary.
 
   (f)   Powers and Duties.
 
   (1)   The Commission’s relationship to the General Manager of the Cultural Affairs Department shall be advisory.
 
   (2)   Notwithstanding its advisory capacity, the Commission shall exercise the powers and duties set forth in Section 22.109 of this Code and any other powers and duties as may be conferred by ordinance.
 
   (3)   In fulfillment of the above responsibilities, the Commission shall be empowered to hold public meetings and committee meetings to seek advice and information from members of the general public and such governmental representatives as may be appropriate, so that the Commission may be informed on matters in the arts, sciences or historic affairs of importance to the City, and so that the information may be made available to the General Manager of the Department.

Sec. 22.109. Board of Cultural Affairs Commissioners Control over Works of Art.
 
   Hereafter, no work of art shall become the property of the City of Los Angeles by purchase, gift or otherwise, unless such work of art or the design of same, together with a statement of the proposed location of such work of art, shall first have been submitted to and approved by the Board of Cultural Affairs Commissioners by a majority vote thereof; nor shall any work of art, until so approved, be erected or placed in or upon, or allowed to extend over or upon any municipal building, street, avenue, park or other public place or ground belonging to or under the control of the City of Los Angeles. The said Board may, when it deems proper, also require a complete model of the proposed work of art to be submitted to such Board. The term “work of art” used in this article shall apply to and include all paintings, mural decorations, inscriptions, stained glass, statues, bas-reliefs and other sculptures, monuments, fountains, arches, gates, and other structures of a permanent character intended for ornament or commemoration. No existing work of art belonging to or in the possession of the City shall be removed, relocated or altered in any way without the like approval of the Board. The design of no public building, bridge, approach, fence, retaining wall, lamp, lamp post, or other similar structure proposed to be erected by or under the authority of the City upon any land or in any place belonging to or under the control of the City shall be adopted by the Board or officer having charge, superintendence or control of the design or construction thereof, unless such design shall have been first submitted to and approved by the Board of Cultural Affairs Commissioners by a majority vote thereof. No arch, bridge, structure or approach belonging to any private individual or corporation shall be permitted to extend over, into or upon any street, avenue, highway or other public place belonging to or under the control of the City of Los Angeles, unless the design and location thereof shall have first been approved by the said Board as hereinabove provided.

Sec. 22.110. Time Limit on Matters Submitted to the Board of Cultural Affairs Commissioners.
 
   If the said Board shall fail to decide upon any matter submitted to it pursuant to Section 21.109 within fifteen days after such submission, its decision shall be deemed unnecessary; provided, however, that the time for such decision may be extended by the Council by resolution.
 
   In the event that the immediate removal or relocation of any existing work of art owned or controlled by the City is deemed necessary by the Board or officer of the City having the charge or custody thereof, the Board of Cultural Affairs Commissioners shall within two days after notice in writing from such Board or office, approve or disapprove such removal or relocation, and in case said Board of Cultural Affairs Commissioners shall fail to so act within two days after the receipt of such notice, it shall be deemed to have approved the same.

Sec. 22.111. Expenditures for Art Productions.
 
   There may be expended for art productions, to be selected by the Cultural Affairs Department and placed in public buildings, grounds or parks of the City, such amount as may be included in the annual budget for the purpose. The work “productions” shall be held to include, among other works of art, mural paintings or decorations which artists may be employed to put on the walls of public buildings, mosaic and stained or painted glass.

Sec. 22.112. Custody and Supervision of Paintings, Documents and Records.
 
   The Cultural Affairs Department of the City of Los Angeles is vested with the custody and supervision of all paintings, documents and records in possession of the City of Los Angeles, of historic or artistic value, and it shall be the duty of said Cultural Affairs Department to supervise and preserve the same in a manner to prevent deterioration; provided, however, that none of the provisions of this article shall apply to paintings, documents or records the custody or supervision of which is vested in any board, commission or officer of said City by the provisions of the City Charter. All paintings, documents and records in the custody and under the supervision of the Department of Municipal Arts on the operative date of this chapter, are hereby transferred to the custody and supervision of the Cultural Affairs Department.

Sec. 22.113. Procurement and Preservation of Materials.
 
   The Cultural Affairs Department is authorized and empowered to procure such additional paintings, documents and records as, in the opinion of the City Council, may be of historic or artistic value, and to properly supervise and preserve the same in a manner to prevent deterioration.

Sec. 22.114. Inspection and Inventory.
 
   The Department of Cultural Affairs shall make, when funds are available therefor, an annual inspection and inventory of all paintings, mural decorations, inscriptions, stained glass, statues, bas-reliefs and other sculptures of permanent character intended for ornament or commemoration which are on loan to or which are otherwise under the charge, care and control of said Department, which are owned, leased, used or possessed by the City of Los Angeles, regardless of where located.
 
   In connection with its duties set forth hereinabove, the Department of Cultural Affairs shall establish and maintain a complete and accurate current inventory record of such works of art.
