Sec. 5.497. Citywide Recycling Trust Fund.
 
   (a)   Creation of the Fund. There is hereby created and established in the Treasury of the City of Los Angeles a special trust fund named the “Citywide Recycling Trust Fund,” hereinafter referred to in this Chapter as the “Fund.”
 
   (b)   Purpose of the Fund. The Fund shall be used for the deposit of the private solid waste hauler AB 939 compliance fees imposed in Los Angeles Municipal Code sections 66.32 through 66.32.8, and the monies deposited in the Fund shall be used solely to pay for industrial, commercial and multi-family recycling programs, including the administration of those programs, and for costs directly related to those programs, including but not limited to public education, technical assistance to private businesses, AB 939 research and documentation, market development, infrastructure development of material recovery/diversion facilities and other programs and efforts approved by City Council designed to increase solid waste diversion rates in the industrial, commercial, multi-family and any other non-residential institutional sectors within the City.
 
   (c)   Charges to the Fund. Any department or bureau seeking payment for costs associated with the programs authorized to be funded by this Fund shall only be allowed to charge direct costs, including but not limited to direct costs for labor, compensated time off (CTO), fringe benefits, and related overhead costs applicable to the bureau or department as published annually in the Controller’s Cost Allocation Plan. All such charges shall be subject to the approval of the Board of Public Works or its authorized designee.
 
   (d)   Fund Administration. The Fund shall be administered and expenditures therefrom shall be authorized by the Board of Public Works or the authorized designee thereof.
 
   (e)   Interest. All interest and other earnings attributable to money in the Fund shall be credited to the Fund and shall be devoted to the purposes thereof. Money in the Fund shall not revert to the General Fund or any other fund of the City.
