Each business shall have in its exterior and interior common area to the public, a receptacle designated for recyclable refuse directly adjacent to any non-recycling designated receptacle. The recycling receptable shall be of similar size of the nonrecycling designated receptacle.

This chapter shall be enforced by the Safety Service Director, or his designee, through periodic inspections, or upon reports from the public. The penalty for noncompliance with this chapter is a noncriminal civil penalty of one thousand dollars ($1,000.00) for the first offense. If a business is found to be noncompliant with this Chapter more than once in a calendar year, then the civil penalty shall be three thousand dollars ($3,000.00).

(a) If it is determined by the Safety/Service Director, or his designee, that a business is not complying with the provisions of this Chapter, the City of Lorain shall cause a notice to be sent to the business organization. The notice shall set forth the civil penalties for noncompliance. The business shall have two (2) days to comply with the provisions of this Chapter from the date of receiving notice.
(b) Such notice may be served by delivering it personally to the owner or leaving it at the owner's place of business or other acceptable location pursuant to the Ohio Rules of Civil Procedure, or by posting it in a conspicuous place on the real estate involved, or by mailing it by certified mail, return receipt requested, to the owner, or by publishing it once in a newspaper of general circulation within the City if it cannot be served in any other ways above mentioned.
