726.01 DEFINITION; EXCEPTIONS TO CHAPTER.
   Vending machine operators within the meaning of this chapter shall mean any shop, commissary or similar place of operation from which automatic food or beverage vending machines are serviced, or any location at which food or beverage vending machines have been installed, provided that this chapter shall not apply to:
   (a)   Vending machines dispensing only bottled, canned or prepackaged nonperishable beverages, or the places of operation from which they are serviced;
   (b)   Vending machines dispensing only prepackaged, nonperishable confections, crackers or cookies, or the places from which they are serviced;
   (c)   Vending machines dispensing only chewing gum, salted nuts, nuts in their natural protective covering or panned bulk candies;
   (d)   Commissaries servicing vending machines dispensing only milk, milk products or frozen desserts which are under an inspection and analysis program acceptable to the Lorain Board of Health.

726.02 FOOD PACKAGE TO BE DATED.
   All food used in vending machine operations shall be good, wholesome food, fresh at the time it is placed in the container, wrapper or package, and the date of placing in the container, wrapper or package shall conspicuously appear on the face thereof.

726.03 THREE DAY LIMIT.
   Only good, wholesome food, fresh in quality and suitable for human consumption, shall be allowed to remain in a vending machine by any owner, dealer, agent or employee. Any food remaining in a vending machine more than the third day from its packaging date as required by Section 726.02 shall constitute a prima facie violation of this section.
