663.02 DEFINITIONS.
   (a)    Activities, as defined in any of the following provisions of the City's Codified Ordinances, occurring on or in any residential property located within the City, and engaged in by an owner, occupant or invitee of the owner or occupant of the property are declared to be criminal nuisance activities. To be a criminal nuisance activity, a criminal conviction is not necessary. There must, however, be probable cause to believe that the criminal activity occurred.
      (1)    Any animal violation under Sections 618.011 (Animals Running at Large), 618.02 (Abandoning Animals), 618.03 (Killing or Injuring Animals), 618.04 (Poisoning Animals), 618.05 (Cruelty to Animals; Animal Care Standards), 618.051 (Cruelty to Companion Animals), 618.13 (Nuisance Conditions/Activities Prohibited), 618.11 (Animal Bites; Quarantine and Reporting), 618.15 (Hunting Prohibited), 618.23 (Rabies Vaccination of Animals Required), 618.24 (Feeding of Wild Life and Stray Animals Prohibited), or 618.01 (Dangerous or Vicious Dogs/Control of Dogs and Other Animals) of the Codified Ordinances;
      (2)    Any disorderly conduct or disorderly activity violation under Sections 648.01 (Riot), 648.02 (Failure to Disperse), 648.04 (Disorderly Conduct), 648.07 (Misconduct at an Emergency), 648.08 (Inducing Panic), 648.09 (Making False Alarms), 630.04 (Minor's Curfew), or 648.05 (Disturbing the Peace) of the Codified Ordinances;
      (3)    Any drug abuse violation under Chapter 622 of the Codified Ordinances;
      (4)    Any gambling violation under Chapter 624 of the Codified Ordinances;
      (5)   Any health, safety or sanitation violation under Chapter 660 of the Codified Ordinances;
      (6)    Any liquor control violation under Sections 612.02 (Sales to and Use by Underage Persons; Securing Public Accommodations), 612.021 (Purchase by Minor, Misrepresentation), 612.03 (Sale to Intoxicated Persons), 612.05 (Permit Required), 612.06 (Low-alcohol Beverages; Sale to and Purchase by Underage Persons Prohibited), or 612.09 (Hours of Sale or Consumption Generally) of the Codified Ordinances;
      (7)    Any obscenity and sex offenses violation under Sections 666.03 (Unlawful sexual conduct with a Minor), 666.04 (Sexual Imposition), 666.06 (Voyeurism), 666.07 (Public Indecency), 666.08 (Procuring), 666.09 (Soliciting), 666.091 (Loitering to Engage in Solicitation), 666.10 (Prostitution), 666.11 (Disseminating Matter Harmful to Juveniles), or 666.12 (Deception to Obtain Matter Harmful to Juveniles);
      (8)    Any family offense or offense against persons violation under Sections 636.02 (Assault), 636.03 (Negligent Assault), 636.04 (Aggravated Menacing), 636.041 (Menacing by Stalking), 636.05 (Menacing), 630.01 (Endangering Children), 636.06 (Unlawful Restraint), 636.08 (Coercion), 636.14 (Telecommunication Harassment), 636.13 (Misuse of 9-1-1 System), 636.18 (Domestic Violence), 636.17 (Temporary Protection Order), or 630.03 (Contributing to the Unruliness or Delinquency of a Child) of the Codified Ordinances;
      (9)    Any property offense under Sections 642.09 (Arson), 642.10 (Criminal Damaging or Endangering), 642.11 (Criminal Mischief), 642.12 (Criminal Trespass), 642.121 (Aggravated Trespass), 642.06 (Injuring Vines, Bushes, Trees or Crops), or 642.25 (Posting Bills without Consent of Owner) of the Codified Ordinances;
      (10)    Any theft or fraud offense under Sections 642.02 (Theft), 642.04 (Unauthorized Use of a Vehicle), 642.31 (Insurance Fraud), 642.05 (Unauthorized Use of Property); 642.14 (Passing Bad Checks), 642.15 (Misuse of Credit Cards), 642.17 (Criminal Simulation), 642.21 (Defrauding Creditors), 642.22 (Receiving Stolen Property), 642.30 (Possession of Criminal Tools), 642.32 (Forgery of Identification Cards), or 642.27 (Fraudulent Use of Telephone) of the Codified Ordinances;
      (11)    Any weapons and explosives violation under Sections 672.03 (Using Weapons While Intoxicated), 672.08 (Failure to Secure Dangerous Ordnance), 672.09 (Unlawful Transactions in Weapons), 672.15 (Pointing and Discharging Firearms), 672.14 (Sling Shot; Bow and Arrow; Air Rifle), or 672.16 (Dirks, Blackjacks, Stun Guns and other Weapons) of the Codified Ordinances;
      (12)    Noise control violation under Sections 649.08 (Restriction on Use of Heavy Duty Equipment), 649.12 (Noise in Residential Districts or Affecting Residential or Institutional Property), or 649.20 (Playing of or Permitting Adverse Noise from Sound Amplifying Devices Prohibited) of the Codified Ordinances;
      (13)    Any alarm system violation under Section 725.07 (False Alarms) of the Codified Ordinances.
   Excluding commercial properties,when four or more criminal nuisance activities, as defined in division (a), occur on separate occasions on the same residential property within any calendar year, the Mayor may declare the premises to be a criminal nuisance property and may abate the nuisance as provided in Codified Ordinance 663.03 .
   For commercial properties under division (a)(13), when twelve or more criminal nuisance activities, as defined in division (a), occur on separate occasions on the same commercial property within any calendar year, the Mayor may declare the premises to be a criminal nuisance property and may abate the nuisance as provided in Codified Ordinance 663.03 .
