612.03 SALES TO INTOXICATED PERSONS .
   (a)   No person shall sell intoxicating liquor to any individual who habitually drinks intoxicating liquor to excess, or to whom the Department of Liquor Control has, after investigation, determined to prohibit the sale of such intoxicating liquor, because of cause shown by the husband, wife, father, mother, brother, sister or other person dependent upon or in charge of such individual, or by the Mayor. The order of the Department in such case shall remain in effect until revoked by the Department. (Ord. 1989-41. Passed 10-10-89. )
   (b)   No permit holder and no agent or employee of a permit holder shall sell or furnish beer or intoxicating liquor to an intoxicated person.

   (c)   Whoever violates any of the provisions of this section is guilty of a misdemeanor of the third degree. Punishment shall be as provided in Section 698.02. (ORC 4301.99(F); Ord. 1976-54. Passed 12-14-76.)
