630.04 CURFEW.
   (a)   No minor of the ages specified in subsection (b) hereof, during the hours specified therein, shall loaf, loiter, wander, stroll or play in, upon or about any public street, highway, alley, park or other public place or public land, or ride aimlessly on or about any public street, highway, alley, park or other public place or public land in any vehicle, or enter upon or be found upon the property of another, without invitation, in the City.
   (b)   Restrictions Based on Age of Minor.
      (1)   No person sixteen and seventeen years of age shall be or remain in or upon any public place within the Municipality during the period beginning:
         At 12:00 a.m. through 6:00 a.m. every night.
      (2)   No person fourteen to fifteen years of age shall be or remain in or upon any public place within the Municipality during the period beginning:
         At 11:00 p.m. through 6:00 a.m. every night.
      (3)   No person thirteen or less years of age shall be or remain in or upon any public place within the Municipality beginning:
         At 10:00 p.m. through 6:00 a.m. every night.
   (c)   No minor, during the hours specified above, shall be in, upon or about any public street, highway, alley, park or other public place or public land, unless such minor is:
      (1)   Accompanied by a parent, legal guardian or other person in loco parentis, or some other person at least twenty-one years of age who has been given permission by such parent, guardian or person in loco parentis to accompany such child, shall not be deemed to be in violation of this section.
      (2)   Engaged in an employment activity, or going directly to or returning directly home from an employment activity.
      (3)   On an errand at the direction of the minor’s parent or guardian.
      (4)   Involved in an emergency.
      (5)   Returning directly from any school, church, lodge or other organization’s event.
   (d)   Any child found in violation of this section shall be taken to the Municipal Building and the parent, guardian or person in loco parentis shall be notified to come to the Municipal Building and take personal charge of the child. The child shall be released only to such parent, guardian or person in loco parentis, or to the juvenile authorities.
   (e)   No parent, guardian or person in loco parentis shall permit any minor to violate any of the provisions of this section.
   (f)   Whoever violates subsection (e) hereof shall be guilty of a minor misdemeanor on a first offense and a misdemeanor of the fourth degree on any subsequent offense. Punishment shall be as provided in Section 698.02.
