642.06 INJURING VINES, BUSHES, TREES OR CROPS.
   (a)   No person, without privilege to do so, shall recklessly cut down, destroy, girdle or otherwise injure a vine, bush, shrub, sapling, tree or crop standing or growing on the land of another or upon public land.

(b)   No person shall:
      (1)   Remove, destroy, cut down, break, injure, trim or prune any tree, ornamental plant or shrub in any street or public ground within the Municipality, or any stake, wire or device protecting the same, except with and in conformance to the written permission of the Service
Director, which permission shall be given only when the Service Director finds that the proposed action is necessary to preserve the appropriate use of the street or public ground, or for the proper protection and development of such tree, plant or shrub.
      (2)   Permit any gas, salt, oil, dye or other substance deterious to plant life to come in contact with the soil surrounding the roots of any tree, ornamental plant or shrub in such manner as to kill or injure the same.
      (3)   Fail to provide a good and sufficient protection for any tree, ornamental plant or shrub in any street or public ground against any injury arising from any building operation or other development of adjacent property of which such person has charge or responsibility.
      (4)   Attach any rope, wire, chain, sign or other device to or upon any tree, plant or shrub in any street or public ground except when employed by the Municipality to do so, or with and in conformance to the written permission of the Service Director.

   (c)   In addition to the penalty provided in subsection (d) hereof, whoever violates this section is liable in treble damages for the injury caused.

   (d)   Whoever violates this section is guilty of a minor misdemeanor. Punishment shall be as provided in Section 698.02.
