Should the improved property owner not install the necessary water lateral within 120 days after notification to the property owner, the Township may make the installation and immediately bill the property owner for the cost of such installation or institute court proceedings to require property owner to make such installation or take other action which the Township finds appropriate. Connection to a water main by an improved property owner shall only be made after such installation is approved by the Township Engineer and all permits have been obtained.

1. Quantity Charge. This schedule is applicable to all metered Customers.
Meter Rates - $7.50 Per 1,000 Gallons Per Quarter.
2. Minimum Charge. Except as provided in § 26-126(2) for multiple consumer units, all metered consumers shall be subject to a quarterly minimum charge of $52.50 for the first 7,000 gallons used.

1. As Provided by Township. In those cases where, in the opinion of the Township Engineer, it is impracticable to install a meter at the time a connection is made to the Water system, a flat rate shall be charged until such time as a meter is installed. In such cases the temporary flat rate to apply during this period shall be the quarterly rate of $15 per Consumer Unit.
2. Building Construction Purposes. The flat rate charge for building construc tion purposes shall be $15 per quarter, per unit of construction; the first quarterly payment shall be payable upon application to the Township for Water service. Such charge per quarter shall cover service until the particular unit of construc tion is completed.
3. Temporary Flat Rates. In those cases where, in the opinion of the Township Manager, it is impracticable to install a meter at the time that a connection is made to the Water System, a flat rate shall be charged until such time as a meter is installed. In such cases the temporary flat rate to apply during this period shall be the quarterly rate of $15 per Consumer Unit.

1. Quantity Charge. When more than one Consumer Unit is served through a common water meter, a multiple consumption charge per quarter shall be imposed for such service, which charge shall be calculated in the following manner: (i) the total consumption through such service connection and meter shall be divided by the number of Consumer Units served thereby; (ii) the schedule of water rates, rents and charges established under subsection (1) of § 26-124 shall be applied to the resultant quotient; and (iii) the resultant pro-rata charge for each Consumer Unit shall be multiplied by the number of Consumer Units served through such service connection and water meter to arrive at the total bill for all Consumer Units served through the common meter and service connection.
2. Minimum Quarterly Charge. There shall be charged a minimum quarterly charge for each Consumer Unit as follows:
A. Where two Consumer Units are served through one connection and one meter, each such Consumer Unit shall be charged a minimum charge of $16.50 or 1/2 the bill based on total consumption, whichever is larger.
B. Where three Consumer Units are served through one connection and one meter, each such Consumer Unit shall be charged a minimum charge of $16.50 or 1/2 of the bill based on total consumption whichever is larger.
C. Where four or more Consumer Units are served through one connection and one meter, each such Consumer Unit shall be charged a minimum charge of $16.50 or a proportionate amount based on the total bill, whichever is larger.

1. Quarterly Payments. All bills for water service or charges shall be rendered in calendar quarters on the first days of January, April, July and October, respectively, in each year, or on such other dates as the Township shall specify, and shall cover a quarterly billing period consisting of the immediately succeeding three complete calendar months. 2. Pro-rata Charge for Fractional Periods. Whenever water service to any Consumer Unit, or unit of construction, as applicable, shall begin after the first day or shall terminate before the last day of any billing period, the water rates, rents and charges for such period shall be prorated equitably for that portion of the billing period during which service was provided by the Township.
3. Recipient. Each bill for water service shall be made out in the name of the consumer.
4. Rebate for Unoccupied Property. No allowance or rebate will be made for unoccupied property unless and until: (1) the Consumer shall have notified the Township of such vacancy in writing; and (2) such vacancy shall continue for at least thirty days. In any such event, service shall be restored only upon the execution of a new application therefor.
5. All billing and payment shall be in accordance with the red flag policies of Chapter 1, Part 12. [Ord. 507]

1. Thirty to Sixty Days After Bills are Due and Payable. All bills for water service furnished to consumers shall be due and payable upon the appropriate billing date and the appropriate amount computed in accordance with this Part shall constitute the net bill. If bills for such water service shall not be paid within thirty days after such bill becomes due and payable, such bills shall be deemed delinquent and a penalty of fifteen percentum shall be added to such delinquent bills and collected as a part thereof. 2. Delinquency in Excess of Sixty Days. Such action may be taken whenever any bill for water service furnished to a consumer shall remain unpaid for a period in excess of sixty (60) days after the date thereof and five days after mailing a delinquency notice to the consumer at his latest recorded address of the books of the Township, which notice shall inform the consumer of the delinquency and the penalty and shall declare the intention of the Township to shut off and discontinue the water service. The water service will not be restored until the bill, including penalties, together with a turn-off and turn-on charge has been paid.

1. Lien Against Property Served by the Water System. Water rates, rents and charges imposed by this Part, to the extent permitted by law, shall be a lien on the property connected to and served by the water system; and any such water rates, rents and charges which shall be delinquent, to the extent permitted by law, shall be filed as a lien against the property so connected to and served by the water system, which lien shall be filed in the Office of the Clerk of Courts - Civil Division of Lehigh County, Pennsylvania, and shall be collected in the manner provided by law for the filing and collecting of municipal claims. The lien shall include costs of preparation of the lien of $80 and preparation of the satisfaction of $25 and any court costs for the filing of and satisfaction of the lien and the cost of collecting such delinquent amounts including reasonable attorney's fees at the rate of $150 per hour. Interest shall accrue on the delinquent rental and penalty at the rate of 10% per annum. [Ord. 449]
2. Authorization of Township Officers. Proper officers of the Township are authorized and directed to do all things and to take all legal action necessary to enforce collection of water rates, rents and charges established and imposed and otherwise to carry out provisions of this Part.

Any person, firm or corporation who shall violate any provision of this Part 1B shall be guilty of a summary offense and shall be fined not less than $300 and/or be imprisoned up to 90 days or both. Each day on which a violation shall occur shall be deemed a separate and distinct offense. In addition to the penalties provided herein, the Township may recover reasonable attorney's fees, court costs, court reporter's fees, and other expenses of litigation by appropriate suit at law against the person found to have violated this Part 1B or the orders, rules and regulations issued hereunder.
