1395.09 FILTRATION SYSTEM REQUIRED FOR EX1STING POOLS.
   All swimming pools, which at the present time have no filtration system, shall be required to install and have the same approved within one year of the effective date of this section.

1395.10 INSPECTION.
   The Health Department and the Building Department shall have the right, at any reasonable hour, to inspect any swimming pool for the purpose of determining that all provisions of this chapter are fulfilled and complied with. Before any swimming pool is used, a final inspection and approval must be had from the Building Department.

1395.11 EXISTING LAW UNAFFECTED.
   In no way are the provisions of this chapter intended to amend or alter any existing City ordinances or State statutes, provisions of which are covered in this chapter.

1395.12 REGISTRATION REQUIRED; FEE.
   No person shall fail to register any public swimming pool, public spa, special use pool or any combination thereof, or fail to pay the fee therefor.

1395.13 O.A.C. CHAPTER 3701-31 ADOPTED.
   The provisions of Chapter 3701-31 of the Ohio Administrative Code, which pertain to public swimming pools, spas and special use pools, are hereby incorporated by reference, as if fully set forth at length herein.

1395.99 PENALTY.
   (a)   Except as provided in subsection (b) hereof, whoever violates any provision of this chapter shall be fined not more than one hundred dollars ($100.00) or imprisoned not more than thirty days, or both.
   Each day on which any such violation continues shall constitute a separate offense. Any such outdoor swimming pool, installed, operated or maintained in violation of provisions of this chapter shall constitute a nuisance, and the City may, in addition to the penalties hereinbefore set forth, maintain any proper action for the abatement of such nuisance.

   (b)   Whoever violates Section 1395.12 is guilty of a misdemeanor of the fourth degree and shall be fined not more than two hundred fifty dollars ($250.00) or imprisoned not more than thirty days, or both. A separate offense shall be deemed committed each day during or on which a violation occurs or continues.
