13-10: CURFEW FOR MINORS; OFFENSES:
   A.   Curfew Offenses Enumerated: The following constitute curfew offenses:
      1.   It is unlawful for any minor under the age of sixteen (16) years to be in, about or upon any place in the city away from the property where the minor resides between the hours of ten o'clock (10:00) P.M. and five o'clock (5:00) A.M. of the following day.
      2.   It is unlawful for any minor sixteen (16) years of age or older and under the age of eighteen (18) years to be in, about or upon any place in the city away from the property where the minor resides between the hours of eleven o'clock (11:00) P.M. and five o'clock (5:00) A.M.
      3.   It is unlawful for a parent or guardian of a minor to knowingly permit, or by insufficient control allow, a minor to violate subsection A1 or A2 of this section.
      4.   It is unlawful for a parent, guardian or other person having the care, custody or supervision of the minor to fail or refuse to take custody of the minor after such demand is made upon him/her by a law enforcement officer who arrests the minor for violation of subsection A1 or A2 of this section.
   B.   Each Violation A Separate Offense: Each violation of the provisions of subsection A of this section shall constitute a separate offense.
   C.   Violation Classified: An adult convicted of a violation of any provision of this section shall be guilty of a class 1 misdemeanor. This offense is designated an incorrigible offense for minors under the jurisdiction of the juvenile court. (Ord. 24 § 2, 4-9-1951; Ord. 96-423, 6-24-1996)
