3-1: DEFINITIONS:
As used in this chapter, the following terms shall have the meanings ascribed to them respectively:
HOTEL: Any bona fide hotel, where, in consideration of payment, food and lodging are habitually furnished to travelers.
OFF-SALE LICENSE: A license to sell spirituous, vinous or malt liquors at retail in original packages for consumption only off the premises, in respect to which the license is issued.
ON-SALE LICENSE: A license to sell spirituous, vinous or malt liquors at retail for consumption upon the premises, in respect to which the license is issued.
ON-SALE RETAILER: Any person operating an establishment where spirituous liquors are sold in the original container and in individual portions for consumption on the premises.
PERSON: The meaning ascribed in section 1-2 of this code, including every manager, agent, servant, officer and employee of any person.
RESTAURANT: Any bona fide restaurant, cafe, or other place of business where, in consideration of money, food without lodging is furnished, and includes all businesses in which food is regularly served, although such services may not be the primary purpose of such establishment.
RESTAURANT RETAIL LIQUOR DEALER: Every person who operates a bona fide restaurant or hotel and restaurant and who also sells or offers for sale at retail any spirituous, vinous or malt liquors in the original packages and in individual portions for consumption on the premises where sold.
RETAIL LIQUOR DEALER: Every person who sells or offers for sale at retail any spirituous, vinous or malt liquors in the original package for consumption off the premises where sold.
SELL: Any sale, exchange, barter, or other act whereby the title to any spirituous, vinous or malt liquors is transferred for a consideration from one person to any other person, and the words, "sale" or "sold" mean and include the act of making such sale or soliciting or receiving an order for such sale, or to traffic in such beverage.
SPIRITUOUS LIQUORS: Alcohol, brandy, whiskey, tequila, rum, gin, vermouth, cordials, absinthe, wine, porter, bitters, and all compounds and mixtures of any of them. (Ord. 5 § 1, 12-19-1949)
