§ 90.35 SUITABLE FENCING.
   The holder of a permit issued pursuant to this subchapter must not allow livestock to run at large and shall provide suitable fencing confining the animals.

§ 90.36 PERMIT PROCEDURES.
   (A)   Payment of fee which shall be set by resolution of the Council, as stated in “Attachment A” (Application for Livestock Permit) incorporated in § 90.41.
   (B)   Livestock keeping permits issued for the first time shall expire at the end of the following December.
   (C)   To renew a permit, the applicant shall apply for renewal by February 28 of the year in which the permit is set to expire. The application shall contain the same information and shall be processed in the same manner as for new applications.

§ 90.37 ENFORCEMENT.
   The town shall, in not less than five business days of receipt of complaint, investigate said complaint. Upon verification or validation of complaint, the animal control officer will then notify the permittee in writing of said complaint. The permittee will have five business days to bring violation into compliance.

§ 90.38 NOTIFICATION OF ANIMAL CONSTITUTING A NUISANCE.
   Notification to the permit holder shall be by certified mail, return receipt requested. Notification shall be deemed completed upon deposit of notice in the United States mail, postage and properly addressed with address provided by permit holder at the time the permit was purchased. Notification shall also be deemed complete upon personal notification by animal control officer.

§ 90.39 PERMIT REVOCATION OR CANCELLATION.
   (A)   Any livestock keeping permit may be revoked, cancelled or suspended by the Town Council at any time during the term thereof; provided that the Town Clerk/Treasurer shall have first received, upon animal control officer’s investigation, a notification to permit holder and non-compliance by permit holder; hold a public hearing on the complaint, and take action upon the complaint, including revocation, cancellation or suspension of the permit, as in the best judgment of the Council and will best serve and protect the public health and welfare of the town.
   (B)   Revocation of a permit shall disqualify the permit holder from keeping livestock for the remainder of the original term of the permit.

§ 90.40 VIOLATIONS.
   Keeping of livestock without first obtaining a permit pursuant to this subchapter shall be a violation and is enforceable pursuant to this subchapter.

§ 90.42 ANIMAL CRUELTY; UNLAWFUL ACTS DESIGNATED.
   (A)   No person shall override, overload, drive an overloaded, overwork, torture or torment an animal or deprive an animal of necessary sustenance.
   (B)   No person shall unnecessarily or cruelly beat, mutilate or kill an animal unless specifically authorized by law.
   (C)   No person shall cause, instigate, be a spectator at or permit a dog fight, cock fight, bull fight (bloodless or otherwise) or other combat involving animals.
   (D)   No person shall abandon any animal.
   (E)   No person shall fail to provide his/her animal with sufficient food and water, proper shelter to protect it from weather (including sunlight and extreme temperatures), veterinary care when needed to prevent suffering and with humane care and treatment.
   (F)   It is unlawful to annoy, bait, harass, torment or tease a confined or chained animal.
   (G)   Unless specifically authorized by law, no person shall willfully maim or disfigure any domestic or wild animal or administer poison or cause to be ingested any foreign object to any such animal, or expose any poisonous substance with the intent that it shall be taken by any animal, except pests of a public health concern.
   (H)   Provisions of this section shall not in any way limit the right of a police officer or animal control officer to kill or destroy any wild or domestic animal if any such officer determines that there is a reasonable danger to the public safety.
