§ 90.16 AUTHORIZATION TO ISSUE CITATIONS.

   Dog control officers of the town and other authorized personnel are authorized to issue citations to the owners or keepers of any dog found to be in violation of this subchapter, in lieu of impoundment. If the owner is not identifiable or locatable, the dog may be impounded.

LIVESTOCK

§ 90.30 DEFINITIONS.

   For the purpose of this subchapter, the following definitions shall apply unless the context clearly indicates or requires a different meaning.

   ANIMAL. A single cow, sheep, pig, horse, pony, mule, goat, any number of fowl or any single hybrid thereof.

   ANIMAL CONTROL OFFICER. A person employed by the town for the purpose of policing or enforcing this subchapter in the town.

   LIVESTOCK. Any cattle, sheep, swine, horses, ponies, mules, llamas, goats or any hybrids thereof.

§ 90.31 PERMIT REQUIRED FOR KEEPING LIVESTOCK.

   (A)   Keeping, maintaining, harboring or boarding of livestock within the limits of the town for more than seven days shall require an annual permit from the town.

   (B)   All permits shall be subject to revocation and cancellation as provided under § 90.39.

   (C)   No permit shall be issued for chickens or other avian livestock without proof from the applicant of adequate shelter (i.e., coop or henhouse) for the livestock. Failure to maintain adequate housing for avian livestock shall be grounds for revocation of the permit under § 90.39. Roosters are not permitted in the town.

§ 90.32 MINIMUM LOT SIZE.

   Issuance of any livestock-keeping permit shall be subject to the following conditions and subject to regularly accepted space requirements for the type of animal being permitted:

   (A)   Keeping of animals requires a minimum lot size of 7,000 square feet;

   (B)   Regularly accepted space guidelines are as follows:

      (1)   Poultry/fowl: Four square feet of space per bird; all birds must be confined to owner's property. Roosters and swine are not allowed within town limits;

      (2)   Goats, llamas, sheep: Fifty square feet per animal;

      (3)   Horses: Four hundred square feet per horse; and

      (4)   Cattle require 150 square feet of space per animal.

   (C)   Permits may be denied for a lack of adequate space for additional livestock.

   (D)   Livestock/animal/fowl pens must be bordered in closer proximity to owner’s residence than adjacent residences on all sides.
