(a) Material is acceptable as fill for a site intended to be used for residential development if the material contains equal to or fewer parts per million of any contaminant than the quantity allowed under the Ohio Environmental Protection Agency's Voluntary Action Program generic direct-contact soil standards for carcinogenic and non-carcinogenic chemicals of concern for residential soils as found in OAC 3745-300-08.
(b) Material is acceptable as fill for a site intended to be used for commercial or industrial development if the soil contains equal to or fewer parts per million of any contaminant than the quantity allowed under the Ohio Environmental Protection Agency's Voluntary Action Program generic direct-contact soil standards for carcinogenic and non-carcinogenic chemicals of concern for commercial or industrial soils as found in OAC 3745-300-08.
(c) Material is acceptable as fill for either residential, commercial or industrial sites if the soil is sand, gravel or other suitable aggregate, solely or in conjunction with clean hard fill.
(d) All other material is unacceptable as fill and will be considered as litter and/or waste and will be in violation and fined under Chapters 551 and 613 of the City Ordinances as well as any other relevant state and federal laws.
